PLEASE SUBSTITUTE FOR ORDINANCE FURNISHED <br />W~TH DOCKET <br /> <br />ORDINANCE NO. 64-78 <br /> <br />BY: Messrs. Brockman., Brown, Chinnock, <br /> Magnotto, McBride, Salmon <br /> <br />AN EMERGENCY ORDINANCE to supplement the Business Regulation Code of the <br />Codified Ordinances of the City of Lakewood by enacting new Sections 741.06, <br />741.07, 741.08 and 741.09 relating to the regulation of'peddlers, hawkers <br />and itinerant vendors. <br /> <br />WHEREAS, this ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public safety and general welfare and for the <br />usual daily operation of municipal departments; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section l. That the Business Regulation Code of the Codified Ordinances of <br />the City of Lakewood be and the same is hereby supplemented by enacting new <br />Sections 741.06, 741.O7, 741.O8 and 741.09 to read as follows: <br /> <br />741.O6 LIMITATIONS UPON SOLICITATION. <br /> <br />(a) <br /> <br />It shall be unlawful for any person to sell or offer for <br />sale, barter, exchange, or to solicit the purchase or gift <br />of any goods, wares, merchandies, or other articles of <br />value or to offer services for hire w'thin the City in any <br />area in which an authoriz, ed public exhibition is being held <br />as defined in Section 725.O1 of this Code except as auth- <br />orized by the exhibition permit holder. <br /> <br />(b) <br /> <br />No person licensed pursuant to this Chapter shall have any <br />exclusive right to any location in the public streets, nor <br />shall be permitted a stationary location, nor shall he be <br />permitted to operate in any congested area where his oper- <br />ations impede and inconvenience the public. <br /> <br />741.07 INVESTIGATION: REFUSAL AND ISSUANCE. <br /> <br />(a) <br /> <br />Upon receipt of an application for a license required by <br />this Chapter the original shall be referred to the Chief <br />of Police, who shall cause such investigation to determine <br />the lawfulness of the applicant's business enterprise and <br />to determine if the applicant has been convicted of any <br />crime or misdemeanor involving violence or deceit, or moral <br />turpitude. <br /> <br />(b) <br /> <br />Following the investigation, as provided herein, the Chief <br />of Police shall forward his recommendations to the Director <br />of Public Safety who shall cause a review of same. Based <br />upon this investigation, the Director of Public Safety <br />shall approve or disapprove the application and notify <br />the applicant by certified mail of his decision. If the <br />application is approved, the Director of Public Safety shall <br />issue a license pursuant to this Chapter. If the application <br />is disapproved, the Director of Public Safety Shall cause <br />the license fee to be returned to the applicant. <br /> <br />741.O8 REVOCATION OF LICENSE. <br /> <br />Licenses issued under this Chapter may be revoked by the Director <br />of Public Safety for any of the following causes: <br /> <br />(a) Fraud, misrepresentation, or fa!se statement contained in <br /> the application for license. <br /> <br />(b) Fraud, misrepresentation or false statement made in the <br /> course of carrying on his business as a peddler. <br /> <br /> <br />
