PLEASE SUBSTITUTE FOR ORDINANCE FURNISHED W~TH DOCKET ORDINANCE NO. 64-78 BY: Messrs. Brockman., Brown, Chinnock, Magnotto, McBride, Salmon AN EMERGENCY ORDINANCE to supplement the Business Regulation Code of the Codified Ordinances of the City of Lakewood by enacting new Sections 741.06, 741.07, 741.08 and 741.09 relating to the regulation of'peddlers, hawkers and itinerant vendors. WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and general welfare and for the usual daily operation of municipal departments; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section l. That the Business Regulation Code of the Codified Ordinances of the City of Lakewood be and the same is hereby supplemented by enacting new Sections 741.06, 741.O7, 741.O8 and 741.09 to read as follows: 741.O6 LIMITATIONS UPON SOLICITATION. (a) It shall be unlawful for any person to sell or offer for sale, barter, exchange, or to solicit the purchase or gift of any goods, wares, merchandies, or other articles of value or to offer services for hire w'thin the City in any area in which an authoriz, ed public exhibition is being held as defined in Section 725.O1 of this Code except as auth- orized by the exhibition permit holder. (b) No person licensed pursuant to this Chapter shall have any exclusive right to any location in the public streets, nor shall be permitted a stationary location, nor shall he be permitted to operate in any congested area where his oper- ations impede and inconvenience the public. 741.07 INVESTIGATION: REFUSAL AND ISSUANCE. (a) Upon receipt of an application for a license required by this Chapter the original shall be referred to the Chief of Police, who shall cause such investigation to determine the lawfulness of the applicant's business enterprise and to determine if the applicant has been convicted of any crime or misdemeanor involving violence or deceit, or moral turpitude. (b) Following the investigation, as provided herein, the Chief of Police shall forward his recommendations to the Director of Public Safety who shall cause a review of same. Based upon this investigation, the Director of Public Safety shall approve or disapprove the application and notify the applicant by certified mail of his decision. If the application is approved, the Director of Public Safety shall issue a license pursuant to this Chapter. If the application is disapproved, the Director of Public Safety Shall cause the license fee to be returned to the applicant. 741.O8 REVOCATION OF LICENSE. Licenses issued under this Chapter may be revoked by the Director of Public Safety for any of the following causes: (a) Fraud, misrepresentation, or fa!se statement contained in the application for license. (b) Fraud, misrepresentation or false statement made in the course of carrying on his business as a peddler.
