ORDINANCE NO. 65-78 <br /> <br />BY: Brockman, Brown, <br /> Magnotto, McBride, Wendling <br /> <br /> AN EMEGENCY ORDINANCE authorizing 'the Mayor, as ex-officio <br />Director of Public Works, to advertise for bids for the leasinq of certain <br />portions of the municipal North Parking Garage on Belle Avenue'in the <br />City, which property is now owned by the City of Lakewood and determining <br />that it is in the best interests of the City that certain portions of said <br />garage be leased on a long-term basis. <br /> <br /> WHEREAS, the City is the owner of a municipal off-street parking <br />garage situated on Belle Avenue and known as "North Parking Garage", and <br /> <br /> WHEREAS, it has come to the attention of this Council that <br />there has been interest expressed in leasing portions of the North Parking <br />Garage on a long-term basis, and ' <br /> <br /> WHEREAS, this Council is of the opinion that it is in the best <br />interest of the City that portions of the North Parking Garage be so leased, <br />and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That this Counci% determi6es that the entire <br />sixth floor, the entire fifth floor and up to ninety (90) spaces on the <br />fourth floor of the municipal North Parking Garage located on Belle Avenue <br />in the City should be leased on a long-term basis and that such lease or <br />leases are in the best interest of the City. <br /> <br /> Section 2. That this Council determines that the leasing of <br />certain portions of the municipal North Parking Garage, as noued in Section <br />1. hereof, will further the interests of the City and its residents. <br /> <br /> Section 3. That the Mayor, as ex-officio Director of Public <br />Works, is hereby authorized and directed to advertise for bids for the <br />leasing of the entire sixth floor and fifth floor of the North Parking <br />Garage and up to a maximum of ninety (90) spaces on the fourth floor <br />of said garage for a term of two years. <br /> <br /> Section 4. That said advertisement shall state that any <br />leasing of any portion of said North Parking Garage shall be subject to <br />the approval of Council; that one bid will be received for all 185 <br />spaces of the sixth floor, without cover, of the North Parking Garage for <br />a two-year period with th~ minimum bid of five dollars ($5.00) per space <br />per month; that one bid will be received for all 185 spaces of the fifth <br />floor of said North Parking Garage for a period of two years with the <br />minimum bid of ten dollars ($10.00) per space per month; that separate <br />bids will be receive~ in groups of fifteen (15) spaces to a maximum of <br />six (6) groups of fifteen (15) spaces of the fourth floor of said <br />North Parking Garage for a period of two years with a minimum bid of <br />fifteen dollars ($15.00) per space per month, and that the City reserves <br />the right to reject any and all bids and any parts thereof, and either party <br />may have the right to terminate upon 60 days 'written notice after one year. <br /> <br /> Section 5. That~ this ordinance is hereby declared to be an <br />.emergency measure for the reasons stated in the preamble hereof and provided <br />it r.eceives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its <br />adoption and approval by the Mayor; otherwise it shall take effect and ~ <br />be in force'l~fr°m and after the earliest period allowed by law~j~ ~--------~-~_/// <br /> ' . .._ ........ -.-' ..-~~~~' ~. . ~ <br /> <br /> <br />
