ORDINANCE NO. 24-79 <br /> <br />BY: Magnotto, McBride, Wendling, <br /> Brockman, Brown, Chinnock <br /> <br /> AFl EMERGENCY ORDINANCE to supplement the Building Code of the Codified <br />Ordinances of the City of Lakewood by enacting new Chapter 1321 of the Building <br />Code relating to the licensing of electricians and heating and air-conditioning <br />contractors and repealing all other ordinances or parts of ordinances inconsistent <br />herewith. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the preservation of the public safety and welfare and for the usual daily operation <br />of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Building Code of the Codified Ordinances of the <br />City of Lakewood be supplemented by enacting new Chapter 1321 of the Building <br />Code which shall read as follows: <br /> <br /> CHAPTER 1321 <br />LICENSING OF ELECTRICIANS AND <br />HEATING AND/OR AIR-CONDITIONING CONTRACTORS <br /> <br />1321.O1 LICENSING REQUIREMENT <br /> <br /> a) No person, corporation, partnership, firm or other business <br />association shall, acting in the capacity of a contractor, engage in <br />heating and/or air-conditioning work or electrical work for which a <br />permit is required without first obtaining a license for each trade <br />from the Building Commissioner. <br /> <br /> b) Contractor, for the purpose of this section, means any <br />person, corporation, partnership, firm or other business association <br />who performs any work specified above for consideration evidenced by <br />an oral or written agreement. No corporation, partnership, firm <br />or other business association shall engage in work for which a <br />license is required, unless at least one responsible member, <br />officer or employee of such corporation, partnership, firm or <br />other business association has been licensed pursuant to this <br />Chapter. All work performed by such corporation, partnership, <br />firm or other business association shall be under the direct <br />supervision of the licensed person. <br /> <br />1321.p2 APPLICATION <br /> <br /> a) Applications for a license shall be on a form issued by <br />the Buildin9 Commissioner. Such licenses shall be 9ranted if the <br />Buiidin9 Commissioner finds the applicant is qualified to perform <br />the work for which the application is sought. <br /> <br /> b) Evidence that the applicant is currently licensed by a <br />city or county which, in the opinion of the Buildin9 Commissioner <br />has a qualified examination, shall be sufficient evidence of qualifi- <br />cation so as to authorize the issuance of a license. Evidence that <br />the applicant has served an apprenticeship in a trade union and passed <br />all necessary requisites of the electrical union which, in the opinion <br />of the Building Commissioner demonstrate the applicant's ability to <br />perform work in compliance wi th all appi ical)le codes and ordinances, <br />shall I)e sufficient evidence of qualification so as to authorize <br />the issuance of a license, <br /> <br /> <br />
