-3- <br /> <br />1321.08 NOTICE OF REVOCATION OR DISAPPROVAL <br /> <br /> a) In the event, the application For a license is not approved or <br />in the event any license issued under this Chapter is revoked, the <br />applicant shall be notified of the refusal or revocation in writing <br />and such notice shall be sent by certified mai] to the applicant <br />at the address of the applicant as set forth 'in the app]ication for <br />a license. The applicant shall have ten (]O) days after receipt of <br />such notice to appeal such refusal or revocation. Such appea] <br />shall be perfected by filing a written notice of the appeal with <br />the Director o'f Public Safety. Thereupon, tile app]icant shall <br />have not less than ten (]0) days notice of the date and place of <br />the hearing. The appeal s'ha11 be heard by the Board of Building <br />Standards and Building Appeals, which Board shall have the power <br />after such hearing to either affirm OF overrule the decision of the <br />Commissioner. The Board shall cause notice of its decision~ to be <br />sent by certified mail to the applicant at the address of the <br />applicant as set forth in the application within thirty (30) days <br />of the date of hearing. <br /> <br />1321.09 PENALTY <br /> <br /> a) Whoever violates any provision of this Chapter sh$]] be guilty <br />of a misdemeanor of the third degree. If tile offender has been pre- <br />viously convicted of a violation of this Chapter, such second or sub- <br />sequent offense shall constitute a misdemeanor of the second degree. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect and be in force from and after the <br />earliest per~od allowed by law and all other ordinances or parts of ordinances <br />inconsistent herewith shall be and are hereby repealed. <br /> <br />/ <br />/ <br /> <br /> <br />
