ORDINANCE NO. 25-79 BY: Brown, Chinnock, Magnot'to., McBride, Wendling, Brockman AN EMERGENCY ORDINANCE to enact new Chapter 1323 of the Building Code of the Codified Ordinances of the City of L~kewood relating to the registration of contractors and repealing all other ordinances or parts of ordinances in- consistent herewith. WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Building Code of the Codified Ordinances of the City of Lakewood be supplemented by enacting new Chapter 1323 relating to registration of contractors which shall read as follows: CHAPTER 1323 REGISTRATION OF CONTRACTORS 1323.O1 'REGISTRATION REQUIREMENT a) No person, corporation, partnership, firm or other business association acting in the capacity of a contractor shall work at the trade or occupation of building, constructing, altering, repairing, painting, moving or demolishing any building or other structure or do landscaping on the site thereof or do any plaster work, mason work, brick laying, roofing work, paving, fencing, or commercial snow plowing by motor vehicle, unless such person, corporation, partnership, firm or other business association has been duly registered as a contractor by the Building Department. b) Persons employed by the owner of the property in the capacity of a Building Custodian shall not be required to register or be otherwise subject to any provisions of this Chapter. c) Contractor, for the purpose of this section, means any person, corporation, partnership, firm or other business association who performs any work specified above for.consideration evidenced by an oral or written agreement. No corpor.ation, partnership, firm or other business association shall engage in work for which a Certificate of Registration is required, unless at least one re- sponsible member, officer or employee of such corporation, partner- ship, firm or other business association has been registered pursuant- to this Chapter. All work performed by such corporation, partnership, firm or other business association shall be under the direct super- vision of the registered person. d) A person, corporation, firm or other business association acting in the capacity of a contractor and performing more than one type of work as se~ forth in Section (a) herein shall only be re- quired to register once annually as a contractor regardless of the number and types of work performed.
