-3- <br /> <br />1323.08 NOTICE OF REVOCATION <br /> <br /> a) In the event the application for a certificate is not approved, <br />or in the event any certificate issued under this Chapter is revoked, <br />the applicant shall be notified of the refusal or revocation in <br />writing and such notice shall be sent by certified mail to the <br />applicant at the address of the applicant as set forth i'n the <br />application for a certificate. The applicant shall have ten (10) <br />days after receipt of Such notice to appeal such refusal or revo- <br />cation. Such appeal shall be perfected by filing a written notice <br />of the appeal with the Director of Public Safety. Thereupon, the <br />applicant shall have not less than ten (10~ days notice of the date <br />and place of the hearing. The appeal shall be heard by the Board <br />of Building Standards and Building Appeals, which Board shall have <br />the power after such hearing to either affirm or overrule the decision <br />of the Commissioner. The Board shall cause notice of its decision <br />to be sent by certified mail to the applicant at the address Of the <br />applicant as set forth in the application within thirty (30) days of <br />the date of hearing.. <br /> <br />1323.09 PENALTY <br /> <br /> a) Whoever violates any provision of this Chapter shall be guilty <br />of a misdemeanor of the third degree. If the offender has been <br />previously convicted of a violation of this Chapter, such second <br />or subsequent offense shall constitute a misdemeanor of the second <br />degree. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force from and after the <br />earliest period allowed by law and all other ordinances or parts of ordinances <br />inconsistent herewith shall be and are hereby repealed. <br /> <br />Adopted: <br /> ' <br /> <br /> <br />
