-3- 1323.08 NOTICE OF REVOCATION a) In the event the application for a certificate is not approved, or in the event any certificate issued under this Chapter is revoked, the applicant shall be notified of the refusal or revocation in writing and such notice shall be sent by certified mail to the applicant at the address of the applicant as set forth i'n the application for a certificate. The applicant shall have ten (10) days after receipt of Such notice to appeal such refusal or revo- cation. Such appeal shall be perfected by filing a written notice of the appeal with the Director of Public Safety. Thereupon, the applicant shall have not less than ten (10~ days notice of the date and place of the hearing. The appeal shall be heard by the Board of Building Standards and Building Appeals, which Board shall have the power after such hearing to either affirm or overrule the decision of the Commissioner. The Board shall cause notice of its decision to be sent by certified mail to the applicant at the address Of the applicant as set forth in the application within thirty (30) days of the date of hearing.. 1323.09 PENALTY a) Whoever violates any provision of this Chapter shall be guilty of a misdemeanor of the third degree. If the offender has been previously convicted of a violation of this Chapter, such second or subsequent offense shall constitute a misdemeanor of the second degree. Section 2. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force from and after the earliest period allowed by law and all other ordinances or parts of ordinances inconsistent herewith shall be and are hereby repealed.
