-2- WHEREAS, as far as it applies to the operation of the Fire Departments of the respective municipal corporations, Section 701.02 of the Ohio Revised Code applies to the contracting political subdivisions and to I~ the Fire Department members when they are rendering service outside of their Il own subdivisions, pursuant to such agreements. WHEREAS, each of the aforesaid municipal corporations has authorized the execution of this contract by proper legislative authority and by proper legislation by their respective Councils. WHEREAS, it is the intent of the parties hereto that this agreement supercede and replace any prior individual mutual agreements entered into between them. NOW, THEREFORE, the parties hereto, each in consideration of the mutual promises and obligations set forth, agree as follows: 1. For the purpose of affording additional fire assistance and protection to themselves and their inhabitants, there shall be an interchange of the services of the Fire Departments, and use of fire personnel and equipment, between the parties hereto, and each of said parties will assist the other party hereto by responding to any call from the ~.iayor, Director of Public Safety, Chief of Fire or other party to this agreemenT, with its fire equipment, personnel, and/or other emergency vehicles, and will render like services while so responding as it renders to itself and its own inhabitants, provided, however, that in no case shall the party hereto called upon or rendering such services be liable in damage to the other party hereto or any of its inhabitants, or contractual obligees, for failure to answer any call, or for lack of speed in answering any such call, or for any inadequacy of equipment, negliment operation of equipment, or for any cause whatsoever growing out of such use of said fire equipment and personnel, nor shall the party hereto, which issued such call.
