77-79 Amend 313.07 Traffic - No Parking Fire Lane signs

ORDINANCE NO. Y?- 79 BY: Brown, Chinnock, McBride, McNally, Salmon AN t~RGENCY ORDINANCE to amend Section 313.07 of the Traffic Code of the Codified Ordinances of the City of Lakewood to prohibit the placing or displaying of unauthorized "No Parking-Fire Lane" signs. WHEREAS, pursuant to Section 351.01(q), the City is authorized to prohibit parking on private property when such parking constitutes a fire hazard or obstruction to or interference with the operation of fire-fighting equipment provided signs are erected giving notice thereof, and WHEREAS, it has come to the attention of this Council that at certain apartment and condcminium'buildings "No Parking -Fire Lane" signs have been erected without authorization, and WHER..E~S, the erection of unauthorized signs has made enforcement of the ban on parking in established fire lanes most difficult and the use of unauthorized signs should be prohibited,, and · WHERF~!S, this ordinance hereby constitutes an emergency measure, providing for the in~ediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department- now, therefore, ' BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 313.07 of the Traffic Code of the Codified Ordinances of the City of Lakewood now reading as follows: 313.07 UNAUTHORIZED SIGNS AND SIGNALS, HIDING FROM VIEW, ADVERTISING. (a) No person shall place, maintain or display upon or in view of any street any ~authorized sign, signal, marking or device which purports to be or is an imitation of or resembles a traffic control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides frcm view or interferes with the effectiveness of any traffic control device or any railroad sign or signal, and no person shall place or maintain, nor shall any public authority permit upon any street any traffic sign or signal bearing thereon any commercial advertising. This section does not prohibit the erection upon private property adjacent to streets of signs giving useful directional information and of a type that cannot be' mistaken for traffic control devices. (b) Every such prohibited sign, signal, marking or device is a public nuisance, and the Police Department is authorized to remove the same or cause it to be removed. (O.R.C. 4511.16) shall be and the same is hereby amended to read as follows: 313.07 UNAUTHORIZE~ SIGNS AND SIGNALS, HIDING FROM VIEW, ADVERTISING. (a) No person shall place, maintain or display upon or in view of any street any unauthorized sign, signal, marking or device which purports to be or is an imitation of or res~lbles a traffic control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any traffic control device or any railroad sign or signal, and no person shall place or maintain, nor shall any public authority permit upon any street any traffic sign or signal bearing thereon any commercial advertising.
