-12- Section 9. That the General Offenses Code of the Codified Ordinances of the City of Lakewood be supplemented by enacting new Section 537.14 to read as follows: 537.14 DOMESTIC VIOLENCE. (a) No person shall knowingly cause or attempt to cause physical harm to a family or household member. (b) No person shall recklessly cause serious physical harm to a family or household member. (c) As Used in this section, "family or household member" means a spouse, person living as a spouse, parent, child or other person related by consanguinity or affinity, who is residing or has resided with the offender. (d) Whoever violates this section is guilty of domestic violence, a misdemeanor of the first degree, if the offender has not previously been convicted of a violation of this section of Ohio R.C. 2919.25. (ORC 2919.25) (e) The same relief available under the Ohio Revised Code for filing a complaint for violationl of Ohio R.C. 2919.25 shall be available for filing a complaint for violation of this section. Section 10. That the General Offenses Code of the Codified Ordinances of the City of Lakewood be supplemented by enacting new Section 537.15 to read as follows: 537.15 TEMPORARY PROTECTION ORDER. (a) No person .shall knowingly violate any terms of a Temporary Protection Order issued pursuant to Ohi© R.C. 2919.26 or Ohio R.C. 3113.-31. (b) No person shall recklessly enter or rgmain on the land or premises which is the subject of a Temporary Protection Order issued pursuant to Ohio R.C. 2919.26 or Ohio R.C. 3113.31, when such protection order excludes the person from the land or the premises. (c) No person being on the land or the premises subject to a Temporary Protection Order.issued pursuant to Ohio R.C. 2919.26 or Ohio R.C. 3113.31 shall negligently fail or refuse to leave ~such premises upon being notified that the Protection Order excludes such person from that land or premises. (d) Whoever violates this section is guilty of Violation of a Temporary Protection Order, a misdemeanor of the fourth degree. (d) As used in this section "land or premises" includes any land, real property, building, structure, home or apartment, and any separate enclosure or room, or portion thereof. Section 11. A copy of such ordinances or parts of ordinances as herein adopted, amended, edited, arranged and numbered or renumbered as parts.of the Codified Ordinances, is attached to this ordinance in the form of 1979 Replacement Pages to the Codified Ordinances. Section 12. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
