-12- <br /> <br /> Section 9. That the General Offenses Code of the Codified Ordinances <br />of the City of Lakewood be supplemented by enacting new Section 537.14 to read <br />as follows: <br /> <br />537.14 DOMESTIC VIOLENCE. <br /> <br />(a) No person shall knowingly cause or attempt to cause physical <br /> harm to a family or household member. <br /> <br />(b) No person shall recklessly cause serious physical harm to a <br /> family or household member. <br /> <br />(c) <br /> <br />As Used in this section, "family or household member" means <br />a spouse, person living as a spouse, parent, child or other <br />person related by consanguinity or affinity, who is residing <br />or has resided with the offender. <br /> <br />(d) <br /> <br />Whoever violates this section is guilty of domestic violence, <br />a misdemeanor of the first degree, if the offender has not <br />previously been convicted of a violation of this section of <br />Ohio R.C. 2919.25. (ORC 2919.25) <br /> <br />(e) <br /> <br />The same relief available under the Ohio Revised Code for <br />filing a complaint for violationl of Ohio R.C. 2919.25 shall <br />be available for filing a complaint for violation of this <br />section. <br /> <br /> Section 10. That the General Offenses Code of the Codified Ordinances <br />of the City of Lakewood be supplemented by enacting new Section 537.15 to read <br />as follows: <br /> <br />537.15 TEMPORARY PROTECTION ORDER. <br /> <br />(a) <br /> <br />No person .shall knowingly violate any terms of a Temporary <br />Protection Order issued pursuant to Ohi© R.C. 2919.26 or Ohio <br />R.C. 3113.-31. <br /> <br />(b) <br /> <br />No person shall recklessly enter or rgmain on the land or <br />premises which is the subject of a Temporary Protection Order <br />issued pursuant to Ohio R.C. 2919.26 or Ohio R.C. 3113.31, <br />when such protection order excludes the person from the land <br />or the premises. <br /> <br />(c) No person being on the land or the premises subject to a <br /> Temporary Protection Order.issued pursuant to Ohio R.C. <br /> 2919.26 or Ohio R.C. 3113.31 shall negligently fail or refuse <br /> to leave ~such premises upon being notified that the Protection <br /> Order excludes such person from that land or premises. <br /> <br />(d) Whoever violates this section is guilty of Violation of a <br /> Temporary Protection Order, a misdemeanor of the fourth degree. <br /> <br />(d) <br /> <br />As used in this section "land or premises" includes any land, <br />real property, building, structure, home or apartment, and any <br />separate enclosure or room, or portion thereof. <br /> <br /> Section 11. A copy of such ordinances or parts of ordinances as herein <br />adopted, amended, edited, arranged and numbered or renumbered as parts.of the <br />Codified Ordinances, is attached to this ordinance in the form of 1979 Replacement <br />Pages to the Codified Ordinances. <br /> <br /> Section 12. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements including Section 121.22 <br />of the Ohio Revised Code. <br /> <br /> <br />
