ORDI:IANCE NO. 45-80 <br /> <br />BY: Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling, Brown <br /> <br /> AN EMERGENCY ORDINANCE to s.upplement Section 1303.04 of the Regional <br />BuiIdlng Code of the Building Code of the Codified Ordinances of the City <br />of Lakewood in order to amend, repeal and enact certain sections of the <br />Regional Buiidlng Code. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public safety and welfare and for <br />the usual daily operation of a mun~clpal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br /> <br /> Section 1. That Section 1303.04 of the Regional Building Code of <br />the Building Code of the Codified Ordinances of the City of Lakewood be <br />supplemented by amending, repealing or enacting certain sections of the <br />Regional Building Code:as follows: <br /> <br />RBC 16Ol.07(d) APPLICATION TO EXISTING BUILDINGS (Amended) <br /> <br /> d) Major Alterations and Repairs. When the cost, as defined in <br />S~ction 1601.O8, of alterations or repairs within any 2-year period exceeds <br />75 per' cent of the value of an existing building or other structure, such <br />building or other structure shall be made to comply with the requirements <br />for new buildings and other new structures. <br /> <br />BBC 1601.O8 ESTABLISHING PROPORTIONATE VALUE (Amended) <br /> <br /> In determining the proportionate value of destroyed part of a building <br />or other structure, or of additions, alterations, or repairs made to a building <br />or other structure, all parts, whether existing, new, or destroyed, and includ- <br />ing plumbing, heating end ventilating equipment, electrical wiring and equip- <br />ment, and other necessary fixed equipment, shall be valued at costs current <br />at the time of evaluation. <br /> <br />RBC 16Ol.lO MAINTENANCE (Amended) <br /> <br /> All buildings or structures and appurtenant structures, and parking <br />surfaces attendant thereto, both existing and new, end ell parts thereof, shall <br />be maintained in a safe and sanitary condition. All devices or safeguards <br />which are required in a building when erected, altered, or repaired, shall <br />be maintained in good working order. The owner shall be responsible for the <br />maintenance of appurtenant structures and parking surfaces attendant thereto. <br /> <br />RBC 1603.02 ELECTRICAL, PLUI~BI~!G, HEATIHG A~ID OTHER EQUIPMENT <br />(Repealed) .' <br /> <br />Section 1603.O2 is hereby repealed. <br /> <br /> RSC 1603.O5 APP. LICATION (Amended) <br /> <br /> An application for a permit shall be filed with the Building Official <br />on a form prescribed by the Building Officlai by the person, corporation, <br />partnership, firm or other business association who shall perform t-he work <br />for which the permit was sought. <br /> <br /> RBC 1603.26'CHANGE OF OCCUPANCY (Amended) <br /> <br /> No change in retail tenancy shall.be made in a building or <br />structure unless a new Certificate o[ Occupancy is secured. <br /> <br /> <br />
