<br />I <br /> <br />OROINANCE NO. <br /> <br />79-80 <br /> <br />BY: Chinnock~Gallagher, Graham, <br />McBri de. :::.a lmon ~ Wendl ing <br /> <br />AN EMERGENCY ORDINANCE to amend Section 505.02 of the General Offenses <br />Code of the Codified Ordinances of the City of lakewood relating to the impounding <br />and disposition of animals. <br /> <br />WHEREAS. thi 5 ordi nance canst; tutes an emergency measure providing for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKENOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 505.02 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />505.02 IMPOUNDING AND DISPOSITION: RECORDS <br /> <br />A police officer or animal warden shall impound every dog and <br />the animal warden shall impound everY cat found in violation of Section <br />505.01. <br /> <br />(a) If the impounded dog is not wearing a valid registration tag, <br />the dog shall forthwith be turned over to an officer charged by law, <br />with the custody and disposal of such dogs. If the dog is wearing a <br />valid registration tag or the identity of the bwneror haborer is <br />otherwise established, notice shall be given prior to or on the next <br />working day to such owner or harborer that the dog has been impounded. <br />Notice may be by telephone or by residence service to the last known <br />address of such owner or harborer. The dog shall not be released except <br />upon the payment of the following charges: for impounding any dog, <br />three dollars ($3.00); for givingnotice, three dollars ($3.00); for <br />keeping any dog, four dollars ($4.00) per day. Any dog not redeemed <br />by the next working day after notice, as herein provided, is given <br />to the owner or harborer, or the next working day following the date <br />it is seized or impounded if the owner or harborer cannot be found, <br />may be sold or otherwise diposed of as provided in Ohio Revised Code <br />Secti on 955.16. <br /> <br />(b) If the impounded cat is wearing an identification tag or <br />the identity of the owner or harborer is otherwise established, notice <br />shall'be given within two days to such owner or harborer that the cat <br />has been impounded. Notice may be by telephone or by residence service <br />to the last known address of such owner or harborer. The cat shall <br />not be released except upon'the payment of the following charges: for <br />impounding any cat, three dollars ($3.00); for keeping any cat, three <br />dollars ($3.00) per day. Any cat not redeemed within three days after <br />notice is given to the owner or harborer. as provided herein, or within <br />three days of the time such cat is seized or impounded., if the owner <br />or harborer cannot be found, may be sold or otherwise disposed of in <br />a humane manner as shall be determined by the animal warden. <br /> <br />(c) Any record of all dogs and cats impounded, the disposition <br />of the same, the owner1s name and address, if knowns and a statement <br />of any costs or receipts involving such dog or cat shall be kept. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />505.02 IMPOUNDING AND DISPOSITION: RECORDS <br /> <br />A police officer or animal warden shall impound every dog and <br />the animal warden shall impound every cat found in violation of <br />Section 505.01. <br />
