ORDINANCE NO. 109-81 <br /> <br />BY: <br /> <br />Brown, Chinnock, Gallagher, <br />Graham, McBride, Salmon, <br />Wendling <br /> <br /> AN EMERGENCY ordinance to amend paragraphs (c) and (d) of Section <br />351.99 of the Traffic Code of the Codified Ordinances of the City of Lakewood <br />to provide for an increase in the fine for violation of "fire lane parking." <br /> <br /> WHEREAS, in order to f~rther discourage the parlting of motor vehicles in <br />designated fire lanes this Council has determined that it is in the best interest <br />of the City to increase the waiver of such violation from $5 to $10 and the <br />late payment from $10 to $1'5, and <br /> <br />for the <br />for the <br /> <br />Code of <br /> <br />WHEREAS, this ordinance constitutes an emergency measure providing <br />immediate preservation of the publi:c health, safety and welfare, and <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That paragraphs (c) and (d) of Section 351.99 of the Traffic <br />the Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />351.00 PENALTY AND WAIVER. <br /> <br />(c) Whoever violates Sections 351.01 through 351.18~ Section <br />351.20(d) or (c), or Section 351.23 may, in lieu of the other <br />penalties provided for the,,violation of such provisions and <br />upon signing a waiver, be fined five dollars ($5.00) if such <br />violator pays such fine at the Traffic Bureau, in person or by <br />mail, within forty-eight hours, or if not within forty-eight <br />hours, then in the sum of ten dollars ($10.00) if such violator <br />pays such amount at the Traffic Burear, in person or by mail <br />within seventy-two hours from the time of violation. In the <br />event such violator does not pay the fine as hereinbefore pro- <br />vided, then a warrant shall be issued and such violator shall be <br />subject to the penalties otherwise provided for the violation of <br />such provisions. <br /> <br />(d) Whoever violates Section 351.27 may, in lieu of the other <br />penalties provided for the violation of such section and upon <br />signing a waiver, be fined ten dollars ($10.00) if such violator <br />pays such fine at ~he Traffic Bureau, in person or by mail, within <br />forty-eight hours, or if not within forty-eight hours, then in the <br />sum of fifteen dollars ($15.00) if such violator pays such amount <br />at the Traffic Bureau, in person or by mail within seventy-two <br />hours fromthe time of violation. In the event such violator <br />does not pay the fine as hereinbefore provided, then a warrant <br />shall be issued and such violator shall be subject to the penalties <br />otherwise provided for the violation of such provision. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />351,00 PENALTY AND WAIVER. <br /> <br />(c) Whoever violates Sections 351.01(a) through (p), (r) or (s) <br />through 351.18, Section 351.20(d) or (c), or Section 351.23 may, <br />in lieu of the other penalties provided for the violation of such <br />provisions and upon signing a waiver, be fined five ($5.00) if <br /> <br /> <br />
