Any facilities required to prevent wastewa~er to a level ~cccptnbie to the City Engineer shall be provided, operated, and main- tanned .~ the user's expense. Detailed plans showing the pretreatment facilities and operating procedures shall be submitted to the City Engineer for review, and shall be. acceptable to the City Engineer before construction of the facility. The review of such plans and operating -~rccc~u~ '.~ in-no way relieve the user from the responsibility of modifvin~ the facility as necessary to prbduce an effluent acceptable to the Citl.' Engineer under the provisions of this Chapter. Any subsequen: changes in ~he pretreatment facilities or method of operation shall be reported to and be acceptable to the City Engineer prior to the user's initiation of the changes. All records relating to compliance with pretreatment standards shall be m~de available by the City Engineer to officials of the EPA or OEPA upon request. SECTIC]! 913.13: CONFIDENTIAL INFORMATION. Information and data on an inaustriat user obtained from reports, questionnaires, permit applications, perm_.its and monitoring programs and from inspections shall be available to the public or other governmental agencies without restriction unless the user specifically requests and is able to demonstrate to the sa~is- faction of the City Engineer that the release of.such information would di%-uige information, processes or methods of production entitled to pro:ec:ion as trade secrets of the user. l;aen requesued by the person furnishing a report, th~ portions of a report which might disclose trade secrets or secret processes shall not be m~de available for inspection by the public but shall be made avail- able upon ~ritten request to governmental agencies for uses related to thio Chaouer, the NPDES Permit, and/or the pretreatment p~ograms; pro- .viCed, however, that such portions of a report shall be available for use by :ne stage or any state agency in judicial review or enforcemen~ proceedings involving the person furnishing the report. Wastewater consgiguents and characteristics will not be recognized as confidential inforr...a:ion. lnfo.-m...agion accepted by the City Engineer as confidential, shal£ nog se ~ransmin:ed to any governmental agency or to the general public by the City Engineer until and unless a ten-day notification is given to the user. SZCUICi: 913.14: SLUDGES GENERATED. Sludges, floats, skimmings, etc., generated by an industrial or commercial pretreatment system shall not be Dlaced into the City's wastewater disposal system. Such sludges shall be con~ained, transported, and disposed of by haulers in accordance wi~h all federal, state, and local regulations. SECTiCi: 913.15: SLUG OR ACCIDENTIAL DISCHARGES. Industrial users shall no:ify the City Engineer immediately upon having a slug or accidential dis'charge of substances ~r wastewater in violJtion of this Chapter in order ~o enable countermeasures to be taken by the City Engineer to minimize damage ~o the wastewater disposal system and the receiving waters. Such notification will not relieve users of liability f~r any exuense, loss or damage to the wastewater disposal system or treatment- process, or for any fines imposed on the City on account thereof under any sna~e or federal law. .-~..e City Engineer may suspend the wastewater treatment service and/or a %~asuewater Discharge Permit when such suspension is necessary, in the ooinion of the City Engineer in order to stop an actual or threatened d~sc~:arge which presents or may present an imminent or substantial endanBerment to the health or welfare of persons, to th~ environment, or ~o the wastewater disposal system, or would cause the City ~o violate any condition of its NPDES Permit.
