Any facilities required to prevent wastewa~er to a level <br />~cccptnbie to the City Engineer shall be provided, operated, and main- <br />tanned .~ the user's expense. Detailed plans showing the pretreatment <br />facilities and operating procedures shall be submitted to the City <br />Engineer for review, and shall be. acceptable to the City Engineer before <br /> construction of the facility. The review of such plans and operating <br />-~rccc~u~ '.~ in-no way relieve the user from the responsibility of <br /> modifvin~ the facility as necessary to prbduce an effluent acceptable <br /> to the Citl.' Engineer under the provisions of this Chapter. Any subsequen: <br /> changes in ~he pretreatment facilities or method of operation shall be <br /> reported to and be acceptable to the City Engineer prior to the user's <br /> initiation of the changes. <br /> All records relating to compliance with pretreatment standards shall <br /> be m~de available by the City Engineer to officials of the EPA or OEPA <br /> <br />upon request. <br /> <br />SECTIC]! 913.13: CONFIDENTIAL INFORMATION. Information and data on an <br />inaustriat user obtained from reports, questionnaires, permit applications, <br />perm_.its and monitoring programs and from inspections shall be available <br />to the public or other governmental agencies without restriction unless <br />the user specifically requests and is able to demonstrate to the sa~is- <br />faction of the City Engineer that the release of.such information would <br />di%-uige information, processes or methods of production entitled to <br />pro:ec:ion as trade secrets of the user. <br /> l;aen requesued by the person furnishing a report, th~ portions of a <br />report which might disclose trade secrets or secret processes shall not <br />be m~de available for inspection by the public but shall be made avail- <br />able upon ~ritten request to governmental agencies for uses related to <br />thio Chaouer, the NPDES Permit, and/or the pretreatment p~ograms; pro- <br />.viCed, however, that such portions of a report shall be available for <br /> use by :ne stage or any state agency in judicial review or enforcemen~ <br /> proceedings involving the person furnishing the report. Wastewater <br /> consgiguents and characteristics will not be recognized as confidential <br /> inforr...a:ion. <br /> lnfo.-m...agion accepted by the City Engineer as confidential, shal£ nog se <br />~ransmin:ed to any governmental agency or to the general public by the <br />City Engineer until and unless a ten-day notification is given to the user. <br /> <br />SZCUICi: 913.14: SLUDGES GENERATED. Sludges, floats, skimmings, etc., <br />generated by an industrial or commercial pretreatment system shall not <br />be Dlaced into the City's wastewater disposal system. Such sludges shall <br />be con~ained, transported, and disposed of by haulers in accordance wi~h <br />all federal, state, and local regulations. <br /> <br />SECTiCi: 913.15: SLUG OR ACCIDENTIAL DISCHARGES. Industrial users shall <br />no:ify the City Engineer immediately upon having a slug or accidential <br />dis'charge of substances ~r wastewater in violJtion of this Chapter in <br />order ~o enable countermeasures to be taken by the City Engineer to <br />minimize damage ~o the wastewater disposal system and the receiving <br />waters. Such notification will not relieve users of liability f~r any <br />exuense, loss or damage to the wastewater disposal system or treatment- <br />process, or for any fines imposed on the City on account thereof under <br />any sna~e or federal law. <br /> .-~..e City Engineer may suspend the wastewater treatment service and/or <br /> a %~asuewater Discharge Permit when such suspension is necessary, in the <br /> ooinion of the City Engineer in order to stop an actual or threatened <br /> d~sc~:arge which presents or may present an imminent or substantial <br /> endanBerment to the health or welfare of persons, to th~ environment, <br /> or ~o the wastewater disposal system, or would cause the City ~o violate <br /> any condition of its NPDES Permit. <br /> <br /> <br />
