In ~he event of a failure of the user to comply voluntarily <br />wigh ~ke suspension order, the City Engineer shall take such steps as <br />deemed necessary, including immediate serverance of the sewer connection, <br />~o preven~ or minimize damage to the wastewater disposal.system or <br />endangermen~ to any individuals. The City Engineer shall'reinstate the <br />Uastewa~er Discharge Permit and/or the wastewater treatment service upon <br />proof of tke elimination of the noncomplying sischarge. A detailed ~ritten <br />statement submitted by the user describing the causes of'~he slug or <br />accidental discharge and the measures taken to prevent any future <br />occurrence shall be submitted to the City Engineer within 15 days of the <br />da~e of occurence. <br /> <br /> SECTIC~: 9!3.16: REVOCATION OF PER~[IT. In accordance with the procedures <br /> of Sect!cs 913.18 of this Chapter, the City Engineer may revoke the permit <br /> of any industrial use~ which fails to factually report the wastewater <br /> constituents and characteristics of his discharge; which fails to report <br /> significant changes in wastewater constituents dr characteristics; which <br /> refuses reasonable access to the user's premises for the purpose of <br /> spec~ion or monitoring; or for violation of conditions of its permit, <br /> this Chapter, or applicable state and federal regulations. <br /> <br />SECTIC]: 913.17: NOTIFICATION OF VIOLATION. Whenever the City Engineer <br />finCs :nag any industrial user has violated or is violaging this Chapter, <br />%~aszawa:ar Discaarge Permit, or any prohibition, limitation or require- <br />=es: com:azna~ herein, the City Engineer may serve upon such person a <br />%~i::en no:ice s:ating ghe mature of the violation. Within 30 days of <br />the da:e of :he notice, a plan for the satisfactory correction thereof <br />shall be submitted to the City by the user. <br /> <br />SECTiOn! 9!3.18: SHO~ CAUSES HEARING FOR INDUSTRIAL USERS. <br /> <br />(a) No~ice of Hearing, If the violation is not corrected by timely <br />compliance uhe City Engineer may order any user which causes or allows <br />an ~nauuhorized discharge to show cause before the City Council why the <br />proposed enforcement action should no~ be taken. A notice shall be <br />served on :he user specifying the time and place of a hearing to be <br />held by the Cigy Council regarding the violation, the reasons why <br />the ac=ion is to be taken, the proposed enforcement action, and directing <br />~he user uo show cause before the City Council why the proposed enforce- <br />men~ acuion should not be taken. The notice of the hearing shall be <br />served personally or by registered or certified mail (return receipt <br />requested) at leasg 10 days before the hearing, ~ervice may be made <br />on any a~en~ or officer of a corporation. <br /> <br /> <br />
