b) Hearing Officials. The City Council may itself conduct the <br />hearing and take the evidence, or may designate any of its members <br />or any officer or employee of the City of Lakewood to: <br /> <br />1. Issue in the name of the City Council notices of hearings <br /> requesting the attendance and testimony of witnesses and <br /> the production of evidence relevant to any matter involved <br /> in such hearings; <br />2. Take the evidence; and, <br />3. Transmit a report of the evidence and hearing, including <br /> transcripts and other evidence, together with recommenda- <br /> tions to the City Council for action thereon. <br /> <br />c) Transcripts. At any hearing held pursuant to this Chapter, <br />testimony taken must be under oath and recorded stenographically. <br />The transcript, so recorded, will be made available to any member <br />of the public or party to the hearing upon payment of the usual <br />charges therefore. <br /> <br />d) Issuance of Orders. After the City Council has reviewed the <br />evidence, it may issue an order to the user responsible for the <br />discharge directing that, following a specified time period, <br />the sewer service be discontinued unless adequate treatment <br />facilities, devices or other related appurtenances shall have <br />been installed or existing treatment facilities, devices or <br />other related appurtenances are properly operated. Further <br />orders and directives as are necessary and appropriate may <br />be issued. <br /> <br />SECTION 913.19 PROHIBITED CONDUCT <br /> <br />a) No person, firm, or corporation shall discharge sewage, <br />industrial waste, or other waste into the City's wastewater <br />disposal system contrary to the provisions of this Chapter, <br />federal or state pretreatment requirements or any order of <br />the City Council. <br /> <br />b) No person shall make any false statements, representations <br />or certifications in any application, record, report, plan or <br />other document filed or required to be maintained pursuant to <br />this Chapter or wastewater disposal permit. <br /> <br />c) No person shall falsely tamper with or knowingly render <br />inaccurate any monitoring device or method required in this <br />Chapter. <br /> <br />SECTION 913.20 CIVIL ACTION <br /> <br />a) Other Regulations. Whenever any person, firm, or corporation <br />fails, neglects or refuses to comply with an order of the <br />City Council or with any provision of this Chapter and the <br />orders, rules and regulations, and permits issued hereunder, <br />the City Engineer may in his .discretion inStitute'and <br />maintain in the name of the 'City of Lakewood an appropriate <br />action at law or in equity to restrain the execution, in <br />violation of this Chapter. <br /> <br />b) Recovery of Damages. Any industrial user who violates any <br />provision of this Chapter or who has a discharge which causes a <br />deposit, obstruction, damage or other impairment to the City's <br />wastewater disposal system shall become liable to the City for <br />any expense, loss, or damage caused by the violation or dis- <br />charge. The City Engineer may add to the user's charges <br />and fees the costs assessed for any cleaning, repair, or <br />replacement work caused by the violation or discharge. <br /> <br /> <br />
