ORDINANCE NO. 69-81 By: Brown~ Chinnock, .Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> An emergency ordinance to provide for the submission to the <br />electorate of an amendment to Article II, Section 8 of the Amended <br />Charter of the City of Lakewood, pertaining to the order of succession <br />to the office of Mayor and Acting Mayor. <br /> <br /> WHEREAS, an emergency exists in that this proposed Charter <br />amendment is to be presented to the electorate of the City of Lakewood <br />at the general election to be held on November 3, 1981; and <br /> <br /> WHEREAS, for the foregoing reason, this ordinance constitutes <br />an emergency measure providing for the immediate preservation of ~he <br />public health, safety and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: <br /> <br /> Section 1. That the question of the amendment to Article II, <br />Section 8 of the Amended Charter of the City of Lakewood, so that as <br />amended the same shall be and read as follows: <br /> <br />ARTICLE II. THE EXECL~IVE. <br /> <br />SECTION 8. ACTING MAYOR. <br /> <br /> If the Mayor dies, resigns or removes his residence from <br />the City, during the term of his office or be removed by the <br />Governor of the State, he sha~l be succeeded in office by <br />officials named below and the order of succession in such <br />cases shall be as follows: Director of Law, Director of <br />Finance, President of Council, and an elector of the City <br />chosen by a ma3ority vote of the members elected to the Council. <br />If said vacancy occurs more than two years and 105 days before <br />the next regular election to be held for the office of Mayor, <br />his successor shall hold office until the first day of January <br />following the next regular municipal election. If the Mayor- <br />elect dies, resigns or removes his residence from the City, <br />after his election but before taking ~ffice, the vacancy shall <br />be filled by appointment made by a majority of the members <br />serving on Council at the time of the commencement of ~he term <br />to be filled and the one so appointed shall hold office until <br />the first day of 3anuary following the nex~ regular municipal <br />election. In either such an event, at the first regular muni- <br />cipal election following the death, resignation, removal of <br />the Mayor from the City, or his removal by the Governor, a <br />Mayor shall be elected for such unexpired term. If said <br />vacancy occurs two years and 105 days or less before the next <br />regular election to be held for the office of Mayor, his <br />successor shall hold office for the balance of the term of the <br />Mayor he succeeds.
