Brown, Chinnock, Gallagher, ORDINANCE NO. 73 -81 By: Graham, McBride, Salmon, Wendling An emergency ordinance to provide for the submission to the electorate of an amendment to Article VI, Section 3 of the Amended Charter of the City of Lakewood, pertaining to the qualifications of the Commissioner of the Division of Health within the Department of Public Safety. WHEREAS, an emergency exists in that this proposed Charter amendment is to be presented to the electorate of the City of Lakewood at the general election to be held on November 3, 1981; and WHEREAS, for the foregoing reason, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: Section 1. That the question of the amendment to Article VI, Section 3 of the Amended Charter of the City of Lakewood, so that as amended the same shall be and read as follows: ARTICLE VI. DEPARTMENT OF PUBLIC SAFETY. SECTION 3. ORGANIZATION. The Divisions of Police and Fire shall each be under the charge of a Chief; the Divisions of. Health and Building Inspection shall be under the charge of a Commissioner; and the Division of Smoke Inspection and Regulation shall be under the charge of an Inspector. Each division shall be further composed of such officers and employees as may be provided by ordinance or resolution of the Council. In case of disaster, riot, conflagration or epidemic, the Mayor may appoint additional patrolmen, firemen or other officers and employees for temporary service. The Commissioner of the Division of Health shall be a physician licensed to practice in the State of Ohio or a person pro- fessionally trained and qualified in providing or adminis- tering public health services, with such training and qualifi- cations being prescribed by ordinance or resolution. The Commissioner of Health need not be a resident of the City. (Upon adoption of this amended Section, the existing Article VI, Section 3 of the Amended Charter of the City of Lakewood shall be repealed.)
