0RDIN~NCE NO. 76--81 <br /> <br />By: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Wendling <br /> <br /> An emergency ordinance to provide for the submission to the <br />electorate of an amendment to Article XI, Section 9 of the Amended <br />Charter of the City of Lakewood, perta~nzng to enactments not subject to <br />referendum. <br /> <br /> WHEREAS, an emergency exists in that this proposed Charter <br />amendment is to be presented to the electorate of the City of Lakewood <br />at the general election to be held on November 3, 1981; and <br /> <br /> WHEREAS, for the foregoing reason, this ordinance constitutes <br />an emergency measure providing for the immediate preservation of the <br />public health, safety and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: <br /> <br /> Section 1. That the question of the amendment to Article XI, <br />Section 9 of the Amended Charter of the City of Lakewood~ so that as <br />amended the same shall be and read as follows: <br /> <br />ARTICLE XI. REFERENDUM. <br /> <br />SECTION 9. ENACTMENTS NOT SUBJECT TO REFERENDUM. <br /> <br /> Notwithstanding any provisions to the contrary in Sections <br />1, 11 or 12 of Article XI of thzs Charter or any other provz- <br />sions of this Charter, ordinances or resolutions enacted as <br />emergency measures for the following purposes shall not be <br />subject to referendum: <br /> <br />(a) To appropriate money for any lawful purpose; <br /> <br />(b) To create, revzse or abolish departments or to provide <br /> regulations for their government; <br /> <br />(c) To aethorize the appoznnment of employees zn any of the <br /> departments; <br /> <br />(d) To authorize, or otherwise affecting, the issuance of <br /> bonds, notes or o~ber debt instruments of the City; <br /> <br />(e) <br /> <br />To authorize a contract for a public improvement or an <br />expenditure of money, which contract is to be paid or <br />expenditure is to be made, in whole or part, from the <br />proceeds of bonds, notes or other debt instruments of the <br />City; and <br /> <br />(f) To provide for the payment of operating expenses of any <br /> department o~ the City. <br /> <br /> <br />
