ORDINANCE NO. 93-81 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Wendling, Salmon <br /> <br /> AN EMERGENCY ORDINANCE providing for the sale of certain real property <br />located on the west side of Ridgewood Avenue, approximately 130 feet north <br />of Madison Avenue in Lakewood, Ohio, bearing permanent parcel numbers <br />315-12-96, 315-12-97 and 315-12-98; determining that such real estate <br />should be sold and that such sale is in the best interest of the City and <br />will further the interest of the City and its residents; and determining <br />that the proposed purchase price is satisfactory. <br /> WHEREAS, said real property (hereinafter described in the body of the <br />agreement) is being used for public parking but is to be replaced by equivalent <br />public parking in other City owned real property resulting in said property <br />not being needed for public use by the City, and <br /> WHEREAS, the sale of the real property is in the best interest of the <br /> City and will further the interest of the City and its residents by assuring <br /> the City its fair market return for said real property and further provide <br /> for urgently needed housing opportunities for senior citizens, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br /> the immediate preservation of public peace, property, health and safety and <br /> for the usual daily operation of a municipal department and for the further <br /> reason that the immediate authorization of actions herein is necessary to <br /> expedite the development and revitalization of the City and to create and <br /> preserve jobs and employment opportunities and to prevent the spread of blighted, <br /> deteriorated or deteriorating conditions; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br /> STATE OF OHIO: <br /> Section 1. That it is hereby determined that the real property described <br /> in the agreement set forth herein is no longer needed for municipal purposes <br /> and the sale of said real property is in the best interest of the City and <br /> will further the interest of the City and its residents by assuring the City <br /> its fair market return for said real estate and further providing for urgently <br /> needed housing opportunities for senior citizens. <br /> Section 2. This Council hereby authorizes the sale of said real property <br /> to the Community Development Corporation of Lakewood, Ohio and the Mayor is <br /> authorized and directed to execute, on behalf ~f the City of Lakewood, a contract <br /> for the sale of said property, in substantially the following form: <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT made and concluded at Lakewood, Ohio, this day of <br />~ 1981, by and between the City of Lakewood, Ohio, a municipal <br />corporation, 12650 Detroit AvenUe, Lakewood, Ohio, hereinafter referred to as <br />"Seller'~ and the Community Development Corporation of Lakewood, a corporation <br />not for profit, 12650 Detroit' Avenue, Lakewood, Ohio, hereinafter referred to <br />as "Purchaser." <br /> <br />WITNESSETH: <br /> <br /> For and in consideration of mutual promises, covenants, and agreements <br />of the parties hereto as herein set forth and other valuable considerations, <br />the receipt and sufficiency of which are hereby acknowledged by each party, <br />the parties hereto hereby agree as follows: <br /> <br /> <br />
