6) Sellers agrees to deliver possession of premises to Purchaser <br />on the date said warranty deed is filed for record in the Office of the <br />Recorder of Cuyahoga County, Ohio. <br /> <br /> 7) Seller agrees to be charged and pay the following expenses: <br /> a) prorationS chargeable to Seller. <br /> <br /> 8) Purchaser agrees to be charged with and pay the following expenses: <br /> a) cost of title examination and issuance of title guarantee <br /> in the amount of Fifty Two Thousand, Five Hundred Dollars <br /> ($52,500); <br /> <br />b) transfer taxes; <br /> <br />c) cost of recording the deed; <br /> <br />d) cost of recording the mortgage, if any; and <br />e) the escrow fee, and prorations chargeable to Purchaser, if any. <br /> <br /> 9) The agreement shall inure to the benefit and be binding upon the <br />heirs, executorS, administrators, successors and assigns of the respective <br />parties hereto, <br /> IN WITNESS WHEREFOR, the parties hereto and hereunder set their hands <br />the day and year first written above. <br /> <br /> SIGNATURES. <br /> Section 3. That it is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action, or in meetings open to the public, in compliance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br /> Section 4. That this ordinance having been declared an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives <br /> the affirmative vote of two-thirds (2/3) of all members elected to Council, <br /> and shall take effect and be in force immediately upon its adoption and approval <br /> by the Mayor; otherwise it shall take effect and be in force from and after <br /> the earliest period allowed by law. <br /> <br /> <br />
