oRDINANCE NO, 1-82 BY: Brown, Chinnock, Gallagher, Graham. McBride, Salmon, Wendling AN EMERGENCY ORDINANCE consenting to the improvement of Lake Avenue from West llTth Street to Webb Road, in the City of Lakewood, all in accordance w~th plans, specifications, and estimates prepared by the City Engineer, and under the supervision of the Department of Transportation, State of Ohio. WHEREAS, the Department of Transportation, State of Ohio, is consider- ing the repair and resurfacing of Lake Avenue from West ll7th Street to Webb Road in the City of Lakewood, and WHEREAS, this CounCil has determined that the improvements herein provided are necessary to eliminate existing hazards to vehicular traffic using the streets of the City of Lakewood, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, said emergency existing by the present condition of said road and for the further reason that it is necessary to expedite the preparation of the plans and specifi- cations for the improvement; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That it is declared to be in the public interest that the consent of the City of Lakewood be and such consent is hereby given to the De- partment of Transportation, State of Ohio, to construct the above-described im- provements in accordance with plans, specifications, and estimates approved by the Department of Transportation, State of Ohio. Section 2. That the CitY of Lakewood hereby proposes to cooperate with the Department of Transportation, State of Ohio, in the above-described improve- ment as follows: (a) By the preparation of plans and specifications for the improvement to be approved by the Department of Transpor- tation, State of Ohio; and (b) By assuming and contributing the non-federal share of the project cost. Section 3. That the Mayor of the City of Lakewood is hereby authorized to enter into maintenance and parking agreements and special contractual obliga- tions. Section 4. That upon completion .of ~:aid improvements the Ci'ty of Lakewood will thereafter keep said street open to traffic at all times, and: (a) Maintain the improvement in accordance with the provisions of the statutes relating thereto and make ample financial provisions for such maintenance~ (b) Maintain the right-of-way and keep it free of obstructions in a manner satisfactory to the Department of Transportation, State of Ohio, and hold said right-of-way inviolate for public highway purposes and permit no signs, posters, billboards, roadside stands or other private installations within the right-of-way limits; and (c) Prohibit parking within the limits of the roadway construct- ed under this ordinance, as follows: No parking on the north side of the roadway between the hours of 4:00 p.m. and 6:30 p.m. except on Saturdays and Sundays. No parking on the south side ef the roadway between the hours of 7:00 a.m. and 9:30 a.m., except Saturday and Sundays.
