Section 5. That traffic control signals will not be installed on <br />the project without prior approval by the Department of Transnortation, State <br />of Ohio, and the City of Lakewood w~l~l pl,ace amd'maintain al~-tra~fic control s~gnals <br />conforming to the Ohio Manual of Uniform Traffic Control Devices on tn~ '~morove- <br />merit in compliance with the provisions of Section 4511.11 and related sections <br />of the Ohio Revised Code. <br /> <br />Section 6. ~§ht-of-way, utility rearrangement: <br /> <br />(a) That all existing street and public right-of-way within the <br /> Municipality which is necessary for the aforesaid improvement, <br /> shall be made available therefor. <br />(b) That any traffic signalization upgrading, relocation of pub- <br /> lically owned utilities or waterline work made necessary by <br /> the improvement will be included in the project but that the <br /> City of Lakewood will cause to be made, at no expense to the <br /> Department of Transportation, State of Ohio, all changes, <br /> alterations or repairs to all private or public utilities which <br /> are not made necessary by the improvement. <br />(c) That the construction, reconstruction, and/or rearrangements <br /> of both publically and privately owned utilities, ~eferred <br /> to in subsection (b) above, shall be done in such a manner as <br /> not to interfere unduly with the operation of the contractor <br /> constructing the improvement, and all backfilling of trencnes <br /> made necessary by such utility rearrangement shall be performed <br /> in accordance with the provision of the Department of Trans- <br /> portation, State of Ohio Construction and Material Specifica- <br /> tions. <br /> <br /> Section 7. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in meet- <br />ings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 8~ That this ordinance is hereby declared to be an emergency <br />measure for the reasons statedin the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br /> C~ERK <br /> <br />Approved~~ ~//~-~. <br /> <br /> <br />
