Section 5. That traffic control signals will not be installed on the project without prior approval by the Department of Transnortation, State of Ohio, and the City of Lakewood w~l~l pl,ace amd'maintain al~-tra~fic control s~gnals conforming to the Ohio Manual of Uniform Traffic Control Devices on tn~ '~morove- merit in compliance with the provisions of Section 4511.11 and related sections of the Ohio Revised Code. Section 6. ~§ht-of-way, utility rearrangement: (a) That all existing street and public right-of-way within the Municipality which is necessary for the aforesaid improvement, shall be made available therefor. (b) That any traffic signalization upgrading, relocation of pub- lically owned utilities or waterline work made necessary by the improvement will be included in the project but that the City of Lakewood will cause to be made, at no expense to the Department of Transportation, State of Ohio, all changes, alterations or repairs to all private or public utilities which are not made necessary by the improvement. (c) That the construction, reconstruction, and/or rearrangements of both publically and privately owned utilities, ~eferred to in subsection (b) above, shall be done in such a manner as not to interfere unduly with the operation of the contractor constructing the improvement, and all backfilling of trencnes made necessary by such utility rearrangement shall be performed in accordance with the provision of the Department of Trans- portation, State of Ohio Construction and Material Specifica- tions. Section 7. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meet- ings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 8~ That this ordinance is hereby declared to be an emergency measure for the reasons statedin the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
