ORDINANCE. NO. 3-82 By: Brown, Gallagher, Graham, McBride, Wendling AN ENERGENCY ordinance to amend Section 373.02 and Paragraphs (c) and (e) of Section 373.t6 to provide for the licensing and registration by the City of motorized bicycles (mopeds) and to provide safety regulations to be observed- by persons operating motorized bicycles similar to those required of motorcycle drivers. WHEREAS, motor vehicle accidents involving motorized bicycles in the City of Lakewood have increased dranmtically, and WHEREAS, motorized bicycles may be operated by persons 1~ years of age and older and this Council i~ concem~ed for the safety of said operators, and WHEREAS, this Council is of the opinion that fo;' the safety and protec- tion of not only the operators of m~torized bicycles but to other p~rsons using 'the highways, that motorized bicycles should be registered and licensed by the City the same as regular bicycles, mad that the operators of motorized bicycles should be required to wear safety glasses or other protective eye devices and operators who are under the age of 18 years, should wear protective helmets, and WHEREAS, this ordinance constitutes an emergency measure providing for the irrmediate preservation of the public health, safety and welfare; now, there- fore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 373.02 now reading as follc~s: 373.02 BICYCLE DEFINED. For the purposes of this Chapter, '%icYcle" and "motorized bicycle" have the meaning provided in Section 301.0~. shall be and the same is hereby amended to read as follows: 373.02 BICYCLE DEFINED. (a) For the purposes of this Section, 'bicycle" and "motorized bicycle" have the meaning provided in Section 301.0~. (b) As used in this Chapter, the term "bicycle" shall include "motorized bicycle" unless otherwise specifically excepted there- from andaxcept as to those provisions which by their nature can have no application to motorized bicycles. Section 2. That Paragraph (c) and (e) of Section 373.16 of the Traffic Code of the Codified Ordinances of the City of Lakewoodnow reading as follows: 373.16 RIDING UPON SEATS; HANDLEBARS; HELNETS AND GLASSES. (c) A person shall ride upon a motorcycle only while sitting astride the seat, facing forward, with one leg on each side of themotorcycle. (e) No person shall operate or be a passenger on a snow- mobile or motorcycle without using safety glasses or other protective eye device. No person who is under the age of eighteen years, or who holds amotorcycle operator's endorse- ment or license bearing a '~ovice" designation that is currently in effect as provided in Ohio R.C. ~507.13, shall operate a motorcycle on a highway, or be a passenger on a motorcycle
