ORDINANCE. NO. 3-82 <br /> <br />By: Brown, Gallagher, Graham, <br /> McBride, Wendling <br /> <br /> AN ENERGENCY ordinance to amend Section 373.02 and Paragraphs (c) and <br />(e) of Section 373.t6 to provide for the licensing and registration by the City <br />of motorized bicycles (mopeds) and to provide safety regulations to be observed- <br />by persons operating motorized bicycles similar to those required of motorcycle <br />drivers. <br /> <br /> WHEREAS, motor vehicle accidents involving motorized bicycles in the <br />City of Lakewood have increased dranmtically, and <br /> <br /> WHEREAS, motorized bicycles may be operated by persons 1~ years of age <br />and older and this Council i~ concem~ed for the safety of said operators, and <br /> <br /> WHEREAS, this Council is of the opinion that fo;' the safety and protec- <br />tion of not only the operators of m~torized bicycles but to other p~rsons using <br />'the highways, that motorized bicycles should be registered and licensed by the <br />City the same as regular bicycles, mad that the operators of motorized bicycles <br />should be required to wear safety glasses or other protective eye devices and <br />operators who are under the age of 18 years, should wear protective helmets, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the irrmediate preservation of the public health, safety and welfare; now, there- <br />fore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 373.02 now reading as follc~s: <br /> <br />373.02 BICYCLE DEFINED. <br /> <br />For the purposes of this Chapter, '%icYcle" and "motorized <br />bicycle" have the meaning provided in Section 301.0~. <br />shall be and the same is hereby amended to read as follows: <br /> <br />373.02 BICYCLE DEFINED. <br /> <br />(a) For the purposes of this Section, 'bicycle" and "motorized <br />bicycle" have the meaning provided in Section 301.0~. <br /> <br />(b) As used in this Chapter, the term "bicycle" shall include <br />"motorized bicycle" unless otherwise specifically excepted there- <br />from andaxcept as to those provisions which by their nature can <br />have no application to motorized bicycles. <br /> <br /> Section 2. That Paragraph (c) and (e) of Section 373.16 of the Traffic <br />Code of the Codified Ordinances of the City of Lakewoodnow reading as follows: <br /> <br />373.16 RIDING UPON SEATS; HANDLEBARS; HELNETS AND GLASSES. <br /> <br />(c) A person shall ride upon a motorcycle only while sitting <br />astride the seat, facing forward, with one leg on each side <br />of themotorcycle. <br /> <br />(e) No person shall operate or be a passenger on a snow- <br />mobile or motorcycle without using safety glasses or other <br />protective eye device. No person who is under the age of <br />eighteen years, or who holds amotorcycle operator's endorse- <br />ment or license bearing a '~ovice" designation that is currently <br />in effect as provided in Ohio R.C. ~507.13, shall operate <br />a motorcycle on a highway, or be a passenger on a motorcycle <br /> <br /> <br />
