unless wearing a protective helmet on his head, and no other <br />person shall be a passenger on a motorcycle operated by such a <br />person unless similarly wearing a protective helmet. The helmet, <br />safety glasses or other protective eye device shall conform <br />with regulations prescribed and prormlgated by the Ohio Director <br />of Highway Safety. The provisions of this subsection or a <br />violation thereof shall not be used in the trial of any civil <br />act i on. <br /> <br />shall be and the same are hereby amended to read as follows: <br /> <br />373.16 RIDING UPON SEATS; HANDLEBARS; HELMETS AND GLASSES. <br /> <br />(c) A person shall ride upon a motorized bicycle or motorcycle <br />only while sitting astride the seat, facing forward, with <br />one leg on each sic~. of the motorized bicycle or motorcycle. <br /> <br />(e) No person shall opecate or be a passenger c~ a snowmobile, <br />motorcycle or motorized b~cycle without using safety glasses <br />or other protective eye device. No person who is under the <br />age of eighteen years, or %.~ho holds a motorcycle operator's <br />endorsement or license bearing a "novice" designation that <br />is currently in effect as provided in Ohio R.C. ~507.13, <br />shall operate a motorcycle or .motorized bicycle on a highway <br />or be a passenger on a motorcycle or motorized bicycle, unless <br />wearing a protective helmet on his head, and no other person <br />shall be a passenger on a motorcycle or motorized bicycle <br />operated by such a person ~nless similarly wearing a protective <br />helmet. The helmet, safety glasses or other protective eye <br />device shall conform with regulations prescribed and <br />prorculgated by the Ohio Director of Highway Safety. The pro- <br />visions of this subsection or a violation thereof shall not <br />be used in the trial of any civil action. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its comnittees that resulted in such fornml action, <br />were in meetings open to the public, in ccapliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section ~. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the prearrble hereof and provided it receives <br />the affirrmtive vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force inrnediately upon its adoption and approval by the <br />Nhyor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law, and existing Section 373.02 and Paragraphs (c) and (e) <br />of Section 373.16 of the Traffic Cede of the Codified Ordinances of the City of <br />Lakewoed are hereby repealed at such time. <br /> <br />Adopted; <br /> <br />Approved <br /> <br /> <br />
