ORDINANCE NO. 4-82 <br /> <br />PLEASE SUBSTITUTE FOR ORDINANCE <br />4-82 AMENDED AND PLACED ON FIRST <br />READING JANUARY 18, 1982, PLACED <br />ON SECOND READING FEBRUARY l, 1982, <br />AND RETURNED TO TRAFFIC AND SAFETY <br />COMMITTEE ON FEBRUARY 16, 1982. <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride <br /> <br /> AN EMERGENCY ORDINANCE supplementing the Building Code of the Codified <br />Ordinances of the City of Lakewood by enacting new Chapter 1331 to require the <br />installation of smoke detectors in all rental residential dwelling units. <br /> <br /> WHEREAS, while national statistics indicate that over 50 percent of <br />all owner occupied homes are equipped with smoke detectors, that less than one <br />third of all rental property, particUlarly in urban areas are equipped with <br />these life saving devices, and <br /> <br /> WHEREAS, inasmuch as there is within the City a large segment of <br />aging rental hoUsing units most likely not protected by smoke detectors, and <br /> <br /> WHEREAS, the installation of smOke detectors in all occupied rental <br />dwelling units would substantially reduce the possibility of fire related <br />deaths within the City and it is in the best interest of the City to require <br />such devices in all rental units, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare; now, <br />therefore, <br /> <br /> · BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Building Code of the Codified Ordinances of the <br />City of Lakewood be supplemented by enacting new Chapter 1331 to read as follows: <br /> <br /> CHAPTER 1331 <br />Smoke Detectors Required in Rental Dwelling Units <br /> <br />1331.01 REQUIREMENT. <br /> <br />It shall be the responsibility of the owner of each <br />new and existing occupied rental dwelling unit to install <br />smoke detectors in each such residential dwelling unit as <br />hereinafter provided. <br /> <br />Said smoke detectors shall be capable of sensing visible or <br />invisible particles of combustion and providing a suitable <br />audible alarm thereof; further they shall be installed by Sept- <br />ember 1, 1982, in the manner hereinafter provided (unless any <br />other provision of County, State of Federal Law shall require <br />installation before that date). Failure to install smoke <br />detectors as and where required by said date will subject the <br />property owner to the penalties set forth in.Section 1331.99. <br /> <br /> 1331.02 LOCATION <br /> <br /> (a) In all dwelling units used for rental purposes at least <br /> one smoke detector shall be installed outside of all sleeping <br /> rooms but in the immediate vicinity of the sleeping area. A <br /> sleeping area is defined as the area or areas of the family <br /> living unit in which the bedrooms (or sleeping rooms)are located. <br /> Where bedrooms or rooms ordinarily used for sleeping are separated <br /> by other-use areas (such as kitchens or living rooms, but not <br /> bathrooms or closets), they shall be considered as separate <br /> sleeping areas for the purposes of this Section. <br /> <br /> <br />
