ORDINANCE NO. 4-82 PLEASE SUBSTITUTE FOR ORDINANCE 4-82 AMENDED AND PLACED ON FIRST READING JANUARY 18, 1982, PLACED ON SECOND READING FEBRUARY l, 1982, AND RETURNED TO TRAFFIC AND SAFETY COMMITTEE ON FEBRUARY 16, 1982. BY: Brown, Chinnock, Gallagher, Graham, McBride AN EMERGENCY ORDINANCE supplementing the Building Code of the Codified Ordinances of the City of Lakewood by enacting new Chapter 1331 to require the installation of smoke detectors in all rental residential dwelling units. WHEREAS, while national statistics indicate that over 50 percent of all owner occupied homes are equipped with smoke detectors, that less than one third of all rental property, particUlarly in urban areas are equipped with these life saving devices, and WHEREAS, inasmuch as there is within the City a large segment of aging rental hoUsing units most likely not protected by smoke detectors, and WHEREAS, the installation of smOke detectors in all occupied rental dwelling units would substantially reduce the possibility of fire related deaths within the City and it is in the best interest of the City to require such devices in all rental units, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare; now, therefore, · BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Building Code of the Codified Ordinances of the City of Lakewood be supplemented by enacting new Chapter 1331 to read as follows: CHAPTER 1331 Smoke Detectors Required in Rental Dwelling Units 1331.01 REQUIREMENT. It shall be the responsibility of the owner of each new and existing occupied rental dwelling unit to install smoke detectors in each such residential dwelling unit as hereinafter provided. Said smoke detectors shall be capable of sensing visible or invisible particles of combustion and providing a suitable audible alarm thereof; further they shall be installed by Sept- ember 1, 1982, in the manner hereinafter provided (unless any other provision of County, State of Federal Law shall require installation before that date). Failure to install smoke detectors as and where required by said date will subject the property owner to the penalties set forth in.Section 1331.99. 1331.02 LOCATION (a) In all dwelling units used for rental purposes at least one smoke detector shall be installed outside of all sleeping rooms but in the immediate vicinity of the sleeping area. A sleeping area is defined as the area or areas of the family living unit in which the bedrooms (or sleeping rooms)are located. Where bedrooms or rooms ordinarily used for sleeping are separated by other-use areas (such as kitchens or living rooms, but not bathrooms or closets), they shall be considered as separate sleeping areas for the purposes of this Section.
