1331.07 SUPPLEMENTAL STANDARDS. <br /> <br />This Chapter is intended to be used with and supplemented by the <br />applicable provisions of NFPA Standards 72-E, 1978 Edition and NFPA Standards <br />74, 1980 Edition'which are hereby incorporated herein. However, if there shall <br />be any conflict between this Chapter and the said supplemental standards, <br />this Chapter and any rules and regulations adopted pursuant thereto shall prevail. <br /> <br />1331.08 TAMPERING PROHIBITED. <br /> <br />No person shall, without privilege to do so, knowingly move, deface, damage, <br />destroy or otherwise improperly tamper with a smoke detector installed pursuant <br />to the provisions of this Chapter so as to destroy or diminish its effectiveness <br />or availability for its intended purpose. <br /> <br />1331.97 ENFORCEMENT. <br /> <br />The Building Commissioner and Fire Chief shall have concurrent <br />jurisdiction to inspect the installation of any smoke detector <br />required to be installed bythis Chapter and any violations <br />found to exist shall subject the property owners to the <br />.penalties set forth in Section 1331.99 hereof. <br /> <br />1331.98 CIVIL LIABILITY IMMUNITY. <br /> <br />The provisions of this Chapter or any violation thereof shall <br />not be used in the trial of any civil action. <br /> <br />1331.99 PENALTIES. <br /> <br />Whoever violates any provision of this Chapter or fails <br />to comply with any written notice or written order issued here- <br />under, is guilty of a minor misdemeanor for a first offense <br />and for a second or subsequent offense shall be guilty of a <br />misdemeanor of the fourth degree. <br /> <br />Each day's violation shall constitute a separate and distinct <br />offense. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage 'of this Ordinance were <br />adopted in an open meeting of this Council, and that all .such deliberations of <br />this Council ~and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />Adopted: <br /> <br />Approved: <br /> / <br /> <br />CURK <br /> <br /> <br />
