ORDINANCE NO. 5-82 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wend!ling AN EMERGENCY ORDINANCE to amend Paragraph (c) of Section 351.21 of the Traffic Code of the Codified Ordinances of the City of Lakewood to provide for exemption from the 8:00 a.m. to ~:00 p.m. parking ban and to provide for a permit therefor to qualifying residents. WHEREAS, the City has previously authorized the Director of Public Safety to exempt qualifying residents on those streets upon which parking is prohibited between the hours of 3:00 a.m. and 6:00 a.m. dally from such prohibition and to exempt qualifying residents from the 8:00 a.m. to ~:00 p.m. snow emergency parking ban, and WHERE~S, it has come to the attention of this Counc~ that the 8:00 a,m. to ~:00 p.m. daily parking ban on the City's streets may cause unreasonable hardship to certain residents on the streets affected by such parking ban, and WHEREAS, this Council is of the opinion that it ~s in the best interest of the City to provide some relief from such parking restriction to those persons meeting certain qualifications and to provide for the issuance of a permit for the parking on such streets dumng such prohibited times, and WHEREAS, this ordinance constitutes an emergency measure provid- ing for the immediate preservation of the public safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Code of follows: Section 1. That Paragraph (c) of Section 351.21 of the Traffic the Codified Ordinances of the City of Lakewood now reading as 351.21 POWERS OF DIRECTOR OF PUBLIC SAFETY (c) The Director of Public Safety is hereby authorized to exempt ~es~dents on those streets upon which parking is pro- hlbited between the hours of 3:00 a.m. and 6:00 a.m. da~ly, from such prohibition and to exempt residents from the 8:00 a.m. to 4:00 p.m. snow emergency parking ban as provided in Section 351.26(c), provided Such residents qualify for such exemption under rules and regulations, as shall be es- tablished by the Director of Public Safety and approved by Council relating thereto. Applications for such exemption shall be filed with the Director of Public Safety who may issue an all night parking permit for any motor vehicle owned by a qualifying applicant, A fee of ten dollars ($10.00) shall be charged for each permit issued hereunder.
