ORDINANCE NO. 5-82 <br /> <br />BY: Brown, Chinnock, <br />Gallagher, Graham, <br />McBride, Salmon, Wend!ling <br /> <br /> AN EMERGENCY ORDINANCE to amend Paragraph (c) of Section <br />351.21 of the Traffic Code of the Codified Ordinances of the City of <br />Lakewood to provide for exemption from the 8:00 a.m. to ~:00 p.m. <br />parking ban and to provide for a permit therefor to qualifying residents. <br /> <br /> WHEREAS, the City has previously authorized the Director of <br />Public Safety to exempt qualifying residents on those streets upon which <br />parking is prohibited between the hours of 3:00 a.m. and 6:00 a.m. dally <br />from such prohibition and to exempt qualifying residents from the 8:00 <br />a.m. to ~:00 p.m. snow emergency parking ban, and <br /> <br /> WHERE~S, it has come to the attention of this Counc~ that the <br />8:00 a,m. to ~:00 p.m. daily parking ban on the City's streets may cause <br />unreasonable hardship to certain residents on the streets affected by such <br />parking ban, and <br /> <br /> WHEREAS, this Council is of the opinion that it ~s in the best <br />interest of the City to provide some relief from such parking restriction to <br />those persons meeting certain qualifications and to provide for the <br />issuance of a permit for the parking on such streets dumng such <br />prohibited times, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure provid- <br />ing for the immediate preservation of the public safety and welfare, and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br />Code of <br />follows: <br /> <br />Section 1. That Paragraph (c) of Section 351.21 of the Traffic <br />the Codified Ordinances of the City of Lakewood now reading as <br /> <br />351.21 POWERS OF DIRECTOR OF PUBLIC SAFETY <br /> <br />(c) The Director of Public Safety is hereby authorized to <br />exempt ~es~dents on those streets upon which parking is pro- <br />hlbited between the hours of 3:00 a.m. and 6:00 a.m. da~ly, <br />from such prohibition and to exempt residents from the <br />8:00 a.m. to 4:00 p.m. snow emergency parking ban as provided <br />in Section 351.26(c), provided Such residents qualify for <br />such exemption under rules and regulations, as shall be es- <br />tablished by the Director of Public Safety and approved by <br />Council relating thereto. Applications for such exemption shall <br />be filed with the Director of Public Safety who may issue <br />an all night parking permit for any motor vehicle owned by <br />a qualifying applicant, A fee of ten dollars ($10.00) shall <br />be charged for each permit issued hereunder. The initial <br />permlt shall be valid from the date of issue up to and includ- <br />ing June 30, 1980, and all subsequent permits shall be valid <br />for a two year period. <br /> <br />shall be and the same ~s hereby amended to read as follows: <br /> <br />351.21 POWERS OF DIRECTOR OF PUBLIC SAFETY. <br /> <br />(c) The Director of Public Safety ~s hereby authomzed to <br />exempt residents on those streets upon which parking is pro- <br />hiblted between the hours of 3:00 a.m~ and 6:00 a.m. daily, <br />and between the hours of 8:00 a.m, and ~:00 p.m. daily from <br />uuch prohibitions and to exempt residents from the 8:00 a.m. <br />to ~:OO p.m. snow emergency parking ban as provided in 351.26(c) <br /> <br /> <br />
