741.09 SALE OF CHRISTMAS TREES. <br /> <br />No person, firm or corporation shall offer Christmas trees for <br />sale out-of-doors or from temporary structures, to the general <br />public, unless a permit therefor has been obtained from the <br />Director of Public Safety as set forth herein. <br /> <br />(a) Lakewood merchants who offer Christmas trees for sale at <br />their regular place of business, shall pay a fee of one dollar <br />($1.00). <br /> <br />{b)' All o'2her persons, firms or corporations and all Lakewood <br />merchants who offer such trees for sale from a location other <br />than their regular place of business, shall pay a fee of ten <br />dollars (SlO.O0) and shal'l also deposit the sum of forty <br />dollars {$40.00) with the Director of Public Safety to guarantee <br />the cost of cleaning the premises and removing any property <br />therefrom after the termination of the business. If the <br />premises on which such business is conducted are not cleaned <br />and all merchandise, property, refuse and temporary structures <br />removed therefrom by January 1 of the following year, the Director <br />shall immediately cause such work to be done and the applicant <br />shall forfeit the deposit. <br /> <br />741.10 EXCEPTIONS. <br /> <br /> The provisions of Sections 741.02, 741.03, ~hd 741.04 shall not <br /> ~pply to: <br /> <br />{a) A duly authorized person soliciting the purchase of goods, <br />wares, merchandise, funds or gifts on behalf of any recognized <br />non-profit, educational, civic, religious, political or charit- <br />able organization. The aforementioned shall register with the <br />Director of Public Safety, stating the name of the organi.za- <br />tion, the nature of the activity being conducted, the duration <br />of such activity and shall furnish any other information <br />deemed necessary by the Director of Public Safety. <br /> <br /> (b) The solicitation by a newspaper carrier of customers for <br />a newspaper which he regularly delivers or will regularly deliver <br />shall not be subject to the provisions of this Chapter. <br /> <br />741.11 REVOCATION OF LICENSE. <br /> <br />A license issued under this Chapter shall be revoked by the <br />Director of Public Safety for any of the following causes: <br /> <br />(a) It is subsequently Jetermined that the licensee provided <br />false, misleading or deceptive information in completing the <br />application form set forth in Section 741.03 or 741.05. <br /> <br />(b) The licensee is convicted of a felony violation or mis- <br />demeanor violation involving m~ral turpitude. <br /> <br />(c) The licensee is convicted of a violation of any provision <br />of this Chapter. <br /> <br /> (d) The licensee canvasses or solicits in an unlawful manner <br /> or in such a manner as to constitute a menace ~o the health, <br /> safety, or general welfare of the public. <br /> <br /> Written notice shall be given to the licensee by personal service <br /> or by certified mail immediately upon such revocation. <br /> <br /> <br />
