741.1'2 APPEAL PROCEDURE. <br /> <br />In the event an application for a license is not approved or in <br />the event any license issued pursuant to the provisions of this <br />Chapter is revoked, written notice shall be given to the <br />applicant or licensee by personal service or by certified mail. <br />The applicant or licensee shall have ten (lO) days after the <br />receipt of such notice to appeal such refusal or revocation. <br />Such appeal shall be perfected by filing a notice of the <br />appeal with the Board of Zoning Code Appeals; thereupon the <br />applicant shall have not less than ten (10) days notice of the <br />date and place of the hearing. The Board of Zoning Code Appeals <br />shall have the power, after such hearing, to either affirm or <br />overrule the decision of the Director of Public Safety. The <br />Board shall cause notice of its dec~sion to be served upon the <br />applicant or licensee by certified mail or personal service <br />within fifteen (15) days of the date of hearing. <br /> <br />741.99 PENALTY. <br /> <br />Whoever violates any provision of this Chapter is guilty of a <br />minor misdemeanor for a first offense, and for a second or sub- <br />sequent offense, shall be guilty of a misdemeanor of the fourth <br />degree. <br /> <br /> Section 2. <br />Code of the Codified <br />is hereby repealed. <br /> <br />That existing Chapter 741 of the Business Regulation <br />Ordinances of the City of Lakewood shall be and the same <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and ~elating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Sectin 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />APPROVED: <br /> // <br /> <br /> <br />
