ORDINANCE NO. 77-82 <br /> <br />BY: Brown, Gallagher, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN ORDINANCE to approve, adopt and enact a new Zoning Code of the <br />Codified Ordinances of the City of Lakewood and to repeal ordinanceS in conflict <br />therewith. <br /> <br /> WHEREAS, the basic provisions of the present Zoning Code of the City <br />of Lakewood were enacted in 1973, and <br /> <br /> WHEREAS, the Planning Commission has been working on revising and <br />updating the existing Zoning Code of the City of Lakewood which has had many <br />amendments since its enactment in 1973, and is desirous of incorporating more <br />modern concepts of zoning which have been developed over the recent years; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE couNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That a new Zoning Code of the City of Lakewood be and the <br />same is hereby approved, adopted and enacted as follows: <br /> <br />Zoning Code on file in the Office of the Clerk of Council of the <br />City of Lakewood <br />Lakewood City Hall <br />12650 Detroit Avenue <br />Lakewood, Ohio 44107 <br /> <br /> Section 2. That said Zoning Code be enacted as Title 3 of Part Eleven <br />Planning and Zoning Code of the Codified Ordinances of the City of Lakewood. <br /> <br /> Section 3. That all provisions of the present Zoning Code of the City <br />of Lakewood enacted as Ordinance 55-73 passed July 2, 1973, and as amended from <br />time to time thereafter and all ordinances and resolutions or part thereof which <br />are in conflict or inconsistent with any provisions of the new Zoning Code are <br />hereby repealed as of the effective date of this ordinance. <br /> <br /> Section 4. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />/PRESIDENT <br /> <br /> <br />
