ORDINANCE 98-82 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham <br /> McBride, Salmon, Wendling <br /> <br /> AN ORDINANCE to enact new Chapter 719 of the'Business Regulation Code <br />of the Codified Ordinances of the City of Lakewood relating to Amusement <br />Devices, Amusement-Device Businesses, and Premises upon which such Businesses <br />are Located and Operated, and repealing existing Chapter 719 and all other <br />ordinances or parts of ordinances inconsistent therewith. <br /> <br /> WHEREAS, the City of Lakewood is a home rule municipality, and by <br />authority of the Constitution of Ohio is empowered in general to enact <br />reasonable local laws for the promotion and protection of the health, safety <br />and general welfare of its citizens; and <br /> <br /> WHEREAS, the City of Lakewood thereby is empowered in particular <br />to enact'necessary and expedient local ordinances in order to prevent and <br />suppress excessive noises, safety and fire hazards, disturbances, disruption <br />of pedestrian traffic, disorderly assemblies, theft of personal property, <br />gambling and truancy; and <br /> <br /> WHEREAS, the City of Lakewood is empowered to license and regulate <br />any lawful place of business or amusement located and operating in the City <br />and is empowered to fix the terms and conditions for the issuance, denial, <br />suspension and revocation of licenses therefor; and <br /> <br /> WHEREAS, recently there has been a substantial increase in the <br />number of amusement devices attempted to be located in and operated upon the <br />premises of many diverse types of businesses throughout the City of Lakewood, <br />which has significant impact on the general welfare and well-being of its <br />citizens; and <br /> <br /> WHEREAS, there are presently no reasonable comprehensive regulations <br />controlling the installation, maintenance or use of amusement devices, <br />amusement, device businesses, or premises upon which they are located and <br />operated throughout the City of Lakewood; and <br /> <br /> WHEREAS, the City Council finds that the licensing of amusement devices, <br />amusement-device businesses, and premises upon which they are located and <br />and operated throughout the City of Lakewood is in the best interest of the <br />public health, safety and general welfare; and <br /> <br /> WHEREAS, it is necessary for the protection and welfare of the <br />citizens of the City of Lakewood to establish standards for the regulation <br />of amusement devices,.amusement-devtce businesses, and the premises upon <br />which they are located and operated; NOW, THEREFORE, ': <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Business Regulation Code of the Codified <br />Ordinances of the City of Lakewood be amended by repealing existing Chapter <br />719 in its entirety and by enacting new Chapter 719 relating to Amusement <br />Devices, Amusement-Device Businesses, and the Premises upon which such <br />Businesses are Located and Operated, which shall read as follows: <br /> <br /> <br />
