719.01 <br /> <br />719.02 <br /> <br />CHAPTER 719 <br />AMUSEMENT DEVICES <br /> <br />TITLE, PURPOSE AND OBJECTIVES. <br /> <br />(a) Title. <br /> <br />This ordinance shall be known and may be cited as the "Lakewood <br />Amusement Device Ordinance." <br /> <br />(b) Purpose and Objectives. <br /> <br />Xt is the purpose of this ordinance and the policy of the City of <br />Lakewood to establish standards for the licensing, regulation and <br />control of amusement devices, amusement-device businesses, and premises <br />upon which they are located and operated for purposes of entertainment <br />of the public and the objectives of this ordinance are to prevent <br />excessive noises, safety and fire hazards, disturbances, disruption <br />of pedestrian traffic, disorderly assemblies, theft of personal <br />property, gambling and truancy within the City of Lakewood. <br /> <br />CONSTRUCTION; SEvERABILITY; APPLICABILITY. <br /> <br />(a) COnstruction. <br /> <br /> This ordinance shall be liberally construed and applied to promote <br /> its purpose and objectives. <br /> <br />(b) Severability. <br /> <br />If any provision of this ordinance or the application thereof to any <br />person or circumstance is held invalid or unconstitutional by any <br />court of competent jurisdiction, such provision shall be deemed a <br />separate, distinct and independent provision, and neither the remainder <br />of this ordinance nor the application of such provision to other <br />persons or circumstances shall be affected thereby. <br /> <br />(c) Applicability. <br /> <br /> (1) The provisions of Chapter 719 shall not apply to any <br /> amusement devices possessed and maintained in residences <br /> and used exclusively without charge by residents thereof and <br /> their invited guests~ <br /> <br /> (2) The provisions of chapter 719 shall not apply to any business <br /> or premises which are used solely for sale or lease of amusement <br /> devices and similiar apparatus. <br /> <br /> (3) Sections 719.10(d), 719.10(e), 719.11(a)(3), 719.11(a)(6), <br /> 719.11(a)(7), and 719.12(e) of Chapter 719 shall not apply to <br /> any business or premises licensed by the Ohio Department of <br /> Liquor Control for on-site consumptionof alcoholic beverages. <br /> <br />2 <br /> <br /> <br />
