THIS AGRE~fl~, mnde and entered into this.., da~ of <br /> ~ 1982 by and between the State of Ohio, Department of <br /> Natural Resouroes, by nn~ through the Director of the Department of Natural <br /> <br /> Resources and the Chief Engineer, De~nt of Natural Resources, herein- <br /> after referred to as the STATE and the ~ act~n~ by and through <br /> its MS,or, hereafter referred to as the CITY, pursuant to Section 1507.05 and <br /> <br /> 1507.051 of the Ohio Revised Code. <br /> WITNESS~A'H THAT.. <br /> <br /> W}~%EAS, there is located in the Oi~ of Lakeweod, between the east <br /> propex~y l~e of 17408 Edgewater Drive to the west p~o~erty Line of 17428 <br /> Edgewater Drive; and the east propert~ ]~ of 17612 Edgewater Drive to the <br /> west proper~ l~e of 1087 ~ebb Read, a private area of shore line contiguous to <br /> Lake Erie which is owned by n~e (9) individun! prepert~ owners. <br /> <br /> AND WH~2~m~, Ssid propert~ OWners have petitioned, the CITY to eot as <br /> their agent with the STATE, for the purpose of Joint],y constructing a preeast <br /> Concrete breakwater a~on~ the shoreline for protection of their properties against <br /> Wave action caused by storms on Lake Erie. <br /> <br /> AND WH]2tF~S, the CITY has agreed to act as agent for the property <br /> <br /> o~uers end by resolution has mn_de application to the STATE on behalf of the <br /> Lakeweod propert~ owners to Joint],v construct the erosion protection facilities. <br /> The need for protection betug consum~=d in by the STATE. <br /> <br /> WP~RF~S, f~n~s for the STATE's share of the construction costs are <br /> available in the State Treasury, special account~ and said fun~s are to be <br /> encumbered to the approved contractor after proper advertising and bidS~ of <br /> the project by the CITY, as hereinafter set forth: <br /> <br /> NOW THEREFORE, in consideration of thn mutual covenants by and between <br /> the parties hereto, the parties agree as follows: <br /> <br /> 1. The CITY will provide construction plans and specifications to <br />perform the project work and will advertise, contract and administer construction <br />of the project. The f~nn! plans, specifications, and e~imates prepared for <br />the CITY, and endorsed by the officials responsible therefore, shall be submitted <br />to the STATE for approval by the Chief Engineer and tF the Director of the <br />Department of Natural Resourees. <br /> <br />-1- <br /> <br /> <br />
