2. The total estimated cost of this project is $156,000. The STATE <br /> <br /> · -agrees to pe~ one-third of the actual total construction costs or $52,000, <br /> whichever is lesser, .~ the CITY agrees to ps~ two-thirds or $104,000, In no <br /> event shall the STATE's Rb-re of the project costs exceed $52,000. <br /> <br /> 3. That prior to initiation of the bidding and construction provisions <br /> set fort~ in paragraph five of this agreement, the CITY -~-1I deposit with the <br /> STATE its two-thirds share of the construction cost estimate, and the total <br /> amount will be deposited in the State Treasury in a special fund for this project. <br /> The STATE's obligation is subject to the receipt of an approved encumbrance of <br /> funds to the contractor. <br /> <br /> 4. The CITY shall p~ovlde without cost to the STATE all lands, <br /> easements, and rights-of_~ necessary for the construction of the project. <br /> <br /> ~. That after final plans, specifications, and estimates have been <br /> <br /> approved by the STATE, the CITY agrees to serve as the eontrsot~nff agency, with <br /> full responsibility for advertising for construction bids, 'awarding contracts, <br /> iuspect~s project work --~ materials. Performance bonds, as generally <br /> required by the CITY, ~b,1 ~ be required of success~al bidders on the project. <br /> The CITY sb-~ fo~ard all proposed construction contracts and bid tabulations <br /> relating thereto, together with its recomme~ndations, to the STATE, for approval <br /> by the STATE, before entering into an~ binding contracts relat~ thereto. <br /> <br /> 6. Upon approval of the contract award by both the STATE and CITY, <br /> <br /> the STATE will enc,,m~er funds to the Contrector(s) to cover the project costs <br /> for work to be performed ,,~er this agreement. Ail periodic invoices for work <br /> performed by contractors, which invoices are approved by the CITY, shall he <br /> forwarded to the STATE for pe~ment by the STATE from said funds. <br /> <br /> 7. If, in the opinion of the CITY, work should be performed which <br /> is not specifically covered in the approved project plan~ and specifications, <br /> approval of such work by both the STATE and CITY must be first mutually agreed <br /> upon. In the event the STATE cannot concur therein, ~o such work shall be done. <br /> No cbs~ges, additions or deletions, shall be ~,_de in the approved p],~e <br /> specifications for this project without the erpress written approval of the STATE. <br /> <br /> 8. That if durt~ construction of this Project soma condition is <br />encountered which will require an over run in q~,,ntitieS, above those contained <br />in the orig4n~! contract, the CITY will immediately call the matter to the <br />attention of the STATE and no further work will be performed on this item on <br />which the over run will occur until the amount thereof and the mat~ of <br />therefore is mutually agreed to. <br /> <br />-2- <br /> <br /> <br />
