This Agreement constitutes the entire agreement <br />between the parties hereto pertaining to the subject matter hereof and supersedes all <br />proposals or prior and contemporaneous agreements or understandings of the parties <br />regarding such subject matter. No waiver of any of the provisions o! this Agreement shall <br />be deemed or shall constitute a waiver of any provision hereof (whether or not similar) nor <br />shall such waiver constitute continuing waiver. Terms and condition_s contained in any <br />Customer purchase order or other ordering document submitted pursuant hereto shall not <br />be deemed to modify this Agreement. <br /> <br />9.
