ORDINANCE NO. 25-83 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Sections 151.O1 and 151.02 of Chapter 151 of the Administrative Code of the Codified Ordinances of the City of Lakewood so as to increase the settlement limit of sundry claims to $500.00. WHEREAS, at the present time, under our current ordinance the settle- ment of sundry claims against the City referred to the Small Claims Commission is limited to $300 or less, and WHEREAS, due to general inflation and increase in costs in the recent years, a number of claims presented against the City exceed the $300 limit, and WHEREAS, it is the opinion of this Council that it is in the best interest of the City to provide for the settlement of sundry claims by the Small Claims Commission in the amount of $500 or less, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 151.O1 of the Administrative Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 151.O1 SETTLEMENT OF CLAIMS OF $300.00 OR LESS. All small, unliquidated claims, actions, causes of action and demands in favor of or against the City shall be referred to the Mayor, Chairman of the Finance Committee of Council and the Director of Law. They are hereby authorized to consider such claims and to settle, adjust and compromise all lawful actions, causes of action, claims and demands in favor of or against the City, providing such settlement, adjustment and compromise may be effected for three hundred dollars ($300.00) or less. shall be and the same is hereby amended to read as follows: 151.O1 SETTLEMENT OF CLAIMS OF $500.00 OR LESS. All small, unliquidated claims, actions, causes of action and demands in favor of or against the City shall be referred to the Mayor, Chairman of the Finance Committee of Council and the Director of Law. They are hereby authorized to consider such claims and to settle, adjust and compromise all lawful actions, causes of action, claims and demands in favor of or against the City, providing such settlement, adjustment and compromise may be effected for five hundred dollars ($500.00) or less.
