ORDINANCE NO: 41-83 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE consentin§ to the improvement of Bunts Road from Clifton Boulevard to Lakewood Heights Boulevard, in the City of Lakewood, all in accordance with plans, specifications, and estimates prepared by the City Engineer, and under the supervision of the D~partment of Transportation, State of Ohio. WHEREAS, the Department of Transportation, State of Ohio, is con- sidering the repair and resurfacing of Bunts Road from Clifton Boulevard to Lakewood Heights Boulevard in the City of Lakewood, and WHEREAS, this Council has determined that the improvements herein provided are necessary to eliminate existing hazards to vehicular traffic using the streets of the City of Lakewood, and WHEREAS, this Ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, said emergency existing by the present condition of said road and for the ~urther reason that it is necessary to e×pedite the preparation of the plans and specifications for the improvement; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That it is declared to be in the public interest that the consent of the City of Lakewood be and such consent is hereby given to the Department of Transportation, State of Ohio, to construct the above- described improvements in accordance with the plans, specifications, and estimates approved by the Department of Transportation, State of Ohio. Section 2. That the City of Lakewood hereby proposes to cooperate with the Department of Transportation, State of Ohio, in the above-described improvement as follows: (a) By the preparation of plans and specifications for the im- provement to be approved by the Department of Transporta- tion, State of Ohio; and (b) By assuming and contributing the non-federal share of the project costs. Section 3. That the Mayor of the City of Lakewood is hereby authorized to enter into maintenance and parking agreements and special contractual obliga- tions. Section 4. That upon completion of said improvements the City of Lakewood will thereafter keep said street open to traffic at all times, and: (a) Maintain the improvement in accordance with the provisions of the stat~tes relating theretn an~ make ampl~ financial provisions for such maintenance; (b) Maintain the rinht-of-way and keep it free of obstructions in a manner satisfactory to the Department of Transporta- tion, State of Ohio, and hold said right-of-way inviolate for public highway purposes and permit no signs, posters, billboards, roadside stands or other private installations within the right-of-way limits.
