Section 5. That traffic control signals will not be installed on <br />the project without prior approval by the Department of Transportation, State <br />of Ohio, and the City of Lakewood will place and maintain all traffic control <br />signals conforming to the Ohio Manual of Uniform Traffic Control Devices on <br />the improvement in compliance with the provisions of Section 4511.11 and <br />related sections of the Ohio Revised Code. <br /> <br />Section 6. Right-of-way, utility rearrangement: <br /> <br />(a) <br /> <br />That all existing street and public right-of-way within the <br />Municipality which is necessary for the aforesaid improve- <br />ment, shall be made available therefor. <br /> <br />(b) <br /> <br />That any traffic signalization upgrading, relocation of <br />publically owned utilities or waterline work made necessary <br />by the improvement will be included in the project but that <br />the City of Lakewood will cause to be made, at no expense <br />to the Department of Transportation, State of Ohio, all <br />changes, alterations or repairs to all private or public <br />utilities which are not made necessary by the improvement. <br /> <br />(c) <br /> <br />That the construction, reconstruction, and/or rearrangements <br />of both publically and privately owned utilities, referred <br />to in subsection (b) above, shall be done in such a manner <br />as not to interfere unduly with the operation of the con- <br />tractor constructing the improvement, and all backfilling <br />of trenches made necessary by such utility rearrangement <br />shall be performed in accordance with the provision of <br />the Department of Transportation, State of Ohio Construc- <br />tion and Material Sepcifications. <br /> <br /> Section 7. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this Ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in meet- <br />ings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 8. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take~ effect and be in force after the earliest <br />period allowed by law. <br /> <br />Approved <br /> <br /> <br />
