ORDINANCE N0.45-83 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendlin~ <br /> <br /> AN EMERGENCY ORDINANCE authorizing an emergency grant to the Lakewood <br />Commission on Aging for the purpose of making non-interest bearing loans to econ- <br />omically needy Lakewood residents to prevent the shut-off of utility services for <br />heating and to declare an emergency. <br /> <br /> · WHEREAS, the State of Ohio's moratorium on utility heating shut-offs <br />terminated April l, 1983; and <br /> <br /> WHEREAS, this Council does hearby determine that economically needy <br />residents of Lakewood, Ohio (the "City")will suffer serious, perhaps even <br />fatal, health problems due to their inability to pay heating utility service <br />charges in order to prevent a shut-off of or to restore their heating <br />utility service; and <br /> <br /> WHEREAS, this Council does hereby determine that it is a proper <br />municipal public purpose for the City to make a grant in the amount of <br />$10,000 to the Lakewood Commission on Aging (the "Grantee") a non-profit <br />corporation organized under the laws of Ohio , for the purpose of allowing <br />the Grantee to administer a program of non-interest bearing loans to <br />economically needy residents of the City to enable such residents to prevent <br />the shut-off of or to_~restore their heating utility services; and <br /> <br /> WHEREA~'this Council hereby determines that it is repugnant to the <br />values and mores, in the year 1983, of the American society generally and to <br />the people of the City-specifically, that infants, the elderly and other <br />economically distressed or dependent persons be left without heat for their <br />residences resulting in grave health problems; and that it is in the public <br />interest of the people of the City generally to provide a form of poor relief <br />through a loan program that supplements other forms of poor relief to assure <br />that persons who are economically distressed do not adversely affect the <br />overall health, safety and welfare of the people of the City generally through <br />an increased incidence of illness, an increase in homelessness within the <br />City and crime to provide the necessary resources to meet the basic need <br />of a heated residence, all of which may result if the City does not <br />supplement other forms of assistance that may prove to be inadequate to <br />meet the needs of such persons in this period of economic distress; and <br /> <br /> WHEREAS, this ordinance is an emergency measure which is necessary <br />for the immediate preservation of the public peace, property, health, <br />safety and welfare for the reason that economically needy residents of the <br />City will suffer serious, perhaps even fatal, health problems due to their <br />inability to pay heating utility service charges in order to prevent a shut- <br />off of or to restore their heating utility service; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Lakewood, <br />Cuyahoga County, Ohio; <br /> <br /> Section 1. That a grant of $10,000 is hereby made and awarded to <br />the Grantee for the making and administration of non-interest bearing loans <br />to economically needy residents of the City for the purpose of preventing <br />such persons' heating utility services from being shut-off or to restore <br />such services. The grant shall be authorized b.v the Mayor's execution of <br />and, subject to the Grantee's acceptance of the terms and conditions <br />the grant substantially in the form as set forth in the Heating ShUt-Off <br />Loan Program Grant Contract (the "Grant Contract"), which Grant Contract <br />is on file with this Council, with such changes in the Grant Contract as <br />the Mayor shall determine not to be substantially adverse to the City. The <br />execution of the Grant Contract by the Mayor shall constiture a conclusive <br />determination by the Mayor that any such change is not substantially adverse <br />to the City. <br /> <br /> <br />
