Section 6. That new Section §21.16 of the Genera) Offenses Code of <br />the Codified Ordinances of the City of Lakewood be enacted to read as fo)lows: <br /> <br /> 521.16 MAINTENANCE OF PARKING LOTS. <br />(a) No person, being the owner or occupant in control of a <br />parking lot used for a business or businesses which sell a <br />product likely to create litter, shall~maiQt~d parking <br />lot unless there is contained thereon~hta~'~6~l~r the de- <br />'posit of refuse. Said refuse container shall be weighted or <br />attached to the ground and equipped with lids and placed in <br />a location accessible to the public for the deposit of litter. <br />~b) It shall be the duty of said owner or person in <br />control of th~ parking lot to collect the refuse deposited <br />in the contailners and to store the refuse in an approved <br />location for rlefuse collection. <br /> <br />(c) Whoever) violates any provision of this Section is <br />guilty of a milnor misdemeanor. <br /> <br /> Section 7. ~t is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of ans of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 8. That this ordinance is hereby declared to be an emergency <br />measure for the reasons~ stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take ef- <br />fect and be in force immediately upon its adoption and approval by the Mayor; <br /> <br />otherwise, it shall take effect <br />allowed by law. <br /> <br />Adopted: ~~ ~, /~/X <br /> <br />and be in force after the earliest period <br /> <br />Approvedj~ 7~ [ ~:7'3' <br /> <br /> <br />
