76-83 Amend sections of Sanitary code - garbage / litter

(c) "Bulk container" shall be defined as a metal container of not less than one (1) cubic yard nor more than eight (8) cubic yards, made of watertight construction with doors and c~nstructed so that they may be emptied mechanically by speci- fically equipped trucks. (d) Whoever is found guilty of violating any provision of this Section shall be guilty of a minor misdemeanor. Section 4. That new Section 1783.23 of the Sanitary Code of the Codi- fied Ordinances of the City of Lakewood is hereby enacted to read as follows: 1783~23 MAINTENANCE OF CONSTRUCTION AND BUILDING SITES. (a) It shall be unlawful for any construction or demolition contractor to fail to provide on site refuse receptacles, bulk containers or detachable units for loose debris, paper, building material waste, scrap building materials, and other refuse produced by those working on the site. All such ma~ terials shall be containerized by the end of each day and the site shall be kept in reasonably clean and garbage free condition. The number of refuse receptacles containers, bulk containers or detachable units shall be determined by the size of the job. Dirt, mud, construction materials or the debris deposited upon any public or private property as a result of the construction or demolition shall be immediat- ly removed by the contractor. The construction site shall be kept clean and orderly at all times. (b) Whoever violates any provision of this guilty of a minor misdemeanor. Section is Section 5. That new Section 505.13 of the General Offenses of ified Ordinances of the City,of Lakewood be enacted to read as follows: ! 505.13 DOG EXCREMENT REMOVAL. the Cod- (a) No person shall allow a dog unde~- his or her control to be upon public property or upon the property of another (absent thercr~qent of the owner or occupant of the property) without some' d~iice designed or intended for the removal or containment of such dog's excrement; nor shall any person fail to remove any excrement deposited by any dog under his or her control. (b) This ordinance shall not apply to guide dogs under the control of a blind person. (c) Whoever violates.any provision of this Section is guilty of a minor misdemeanor and for each subsequent offense a mis- demeanor of the fourth degree.
