ORDINANCE NO, 79-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Paragraphs (a) and (b) of Section <br />769.08 of the Business Regulations Code of the Codified Ordinances of the City <br />of Lakewood relating to rates of fare for taxicabs. <br /> <br /> WHEREAS, three of the City's larger taxicab companies have requested <br />that permissible rates of fare be increased due to the fact that drivers are <br />now independent contractors and the drivers costs have increased due to <br />increases in gas and maintenance, cost of new vehicles, and due to said <br />increase in costs drivers are earning less money than previously, and in order <br />to keep drivers on the streets, it is necessary to permit some increase in taxi <br />rates, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public safety and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Paragraphs (a) and (b) of Section 769.08 of the <br />Business Regulation Code of the Codified Ordinances of the City of Lakewood now <br />reading as follows: <br /> <br />769.08 RATES OF FARE. <br /> <br />(1) <br /> <br />Metered Rates. <br />(a) For the first one sixth mile or fraction thereof <br /> eighty cents (80¢). <br />(2) For each succeeding two-ninths mile or fraction <br /> thereof twenty cents (20¢). <br />(3) For each additional passenger for the entire trip <br /> twenty-five cents (25¢). <br />(4) For each taxicab employed upon an hourly rate eight <br /> dollars ($8.00) per hour. <br />(5) In addition to the above rates, five cents (5¢) <br /> may be added for the first one-sixth mile or frac- <br /> tion thereof, for each five cents (5¢) increase <br /> in the cost of gasoline for taxicabs, above forty <br /> cents (40¢) per gallon. <br /> <br />For waiting time, as hereinafter defined, charges may be <br />made at the rate of not less than four dollars and fifty <br />cents ($4.50) per hour nor more than eight dollars ($8.00) <br />per hour. Waiting time is deemed to include the time when <br />the taxicab is not in motion, beginning at the place of <br />arrival to which it has been called, or the time consumed <br />while standing at the direction of the ~passenger. No <br />charge shall be made for time lost because of the ineffi- <br />ciency of the taxicab or its operator, or for the time <br />consumed by premature response to the passenger's order. <br /> <br />(b) Hourly and Flat Rate. Taxicabs may accept employment <br />whereby the fare is to be computed on an hourly rental <br />basis or upon a flat rate of one dollar and eighty-five <br />cents ($1.85) for any ride in the City. A charge of <br />twenty-five cents (25¢) may be made for each additional <br />passenger. <br /> <br />Five cents (5¢) may be added to the flat rate of one dollar <br />and eighty-five cents ($1.85) for any ride within the City, <br />for each five cent (5¢) increase in the cost of gasoline <br />for taxicabs, above forty cents (40¢) per gallon. <br /> <br /> <br />
