ORDINANCE NO. 115-84 <br /> <br />BY: Brown, Chinnock, Gallagher, McBride, <br /> Salmom, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor for and on behalf of the <br />City of Lakewood to enter into a Lease Agreement with the Lakewood Commission <br />on Aging, an Ohio non-profit corporation, for the premises located at 17626 Can- <br />non Avenue, Lakewood, Ohio, for the purpose of permitting the Lakewood Commis- <br />sion on Aging to establish a congregate living facility for the elderly. <br /> <br /> WHEREAS, in 1977 in conjunction with the development of Webb Road <br />Park the City purchased the property at ')7626 Cannon Avenue in the City <br />utilizing Community Development Block Grant funds, said title subject to a life <br />estate, and <br /> <br /> WHEREAS, ON May 17, 1984, the life tenant passed away and fee simple <br />title now vests with the City of Lakewood, and <br /> <br /> WHEREAS, the Lakewood Commission on Aging, an Ohio non-profit corpora- <br />tion desires to and has the ability to establish and operate a congregate <br />living facility for the elderly at the Cannon Avenue location, and <br /> <br /> WHEREAS, this Council believes it to be in the best interest of the <br />City to lease the Cannon Avenue property to said non-profit corporation and <br />same will further the interests of the City and its residents, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Council hereby determines that the real property lo- <br />cated at 17626 Cannon Avenue should be leased for the purpose of establishing a <br />congregate living facility for the elderly and that the lease of said property <br />is in the best interest of the City and will further the interests of the City <br />and its residents. <br /> <br /> Section 2. That the Mayor for and on behalf of the City is hereby <br />authorized and directed to enter into a 15 year term lease agreement with the <br />Lakewood Commission on Aging, an Ohio non-profit corporation for the single <br />family dwelling with detached garage located at 17626 Cannon Avenue, Lakewood, <br />Ohio, for the purpose of establishing a congregate living facility for the elder- <br />ly, said lease to be substantially in the form of the lease agreement attached <br />hereto as Exhibit "A" and made a part hereof as if fully rewritten herein. <br /> <br /> Section 5. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 6. That this ordinance is hereby declared to be an emergency <br />measure for the reasons set forth in the preamble hereof and provided it <br />receives the affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br /> <br />
