PLEBE SUBSTITUTE FOR ORDI- <br />NA~ 'REFERRED TO THE COM- <br />MITIEE OF THE WHOLE ON <br />FEBRUARY 4, 1984. <br /> <br />ORDINANCE NO. 15-84 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 905.02 and 905.15 and enact <br />new Section 905.98 of the Streets and Public Services Code of the Codified Ordi- <br />nances of the City of Lakewood relating to permits and regulations for picnics <br />at Lakewood Park. <br /> <br /> WHEREAS, in order to better serve the interests of the residents of <br />the City of Lakewood, this Council determines that for groups of ten or more per- <br />sons who wish to hold picnics in the Kiwanis Pavilion and/or the Shelter House <br />Pavilion at Lakewood Park, that not less then 50 percent of such group should <br />be residents of the City of Lakewood, and <br /> <br /> WHEREAS, in order to ensure the cleanliness of said pavilions, <br />deposits guaranteeing the costs of cleaning 'the premises after use should be <br />required of such groups, and <br /> <br /> WHEREAS, Council further determines that the Superintendent of Parks <br />should be given the authority to establish further rules and regulations relat- <br />ing to the operation, use, and maintenance of the public parks within the City <br />which are not inconsistent with the ordinances of the City, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 905.02 of the Streets and Public Services <br />Code of the Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />905.02 HOURS OPEN TO PUBLIC. <br /> <br />(a) Parks shall be open daily for use by the general pub- <br />lic. <br /> <br />(b) No person other than an on-duty employee of the City <br />shall enter into or remain within the limits of Lakewood <br />Park, Madison Park, or Kaufman Park between the hours of <br />11:00 p.m. and sunrise. <br /> <br />(c) No person, other than an on-duty employee of the City <br />shall enter into or remain within the limits of Webb Park, <br />Wagar Park, Edwards Park, or Cove Park during the time <br />from one hour after sunset to sunrise. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />905.02 HOURS OPEN TO PUBLIC. <br /> <br />(a) Parks shall be open daily for use by the general pub- <br />lic. <br /> <br />(b) No person other than an on-duty employee of the City <br />shall enter into or remain within the limits of Webb Park, <br />Wagar Park, Edwards Park, or Cove Park, during the time <br />from one hour after sunset to sunrise. <br /> <br />(c) The Kiwanis Pavilion and the Shelter House Pavilion <br />situated at Lakewood Park shall be open for use by permit <br />holders from June 1 through September 30 of each calendar <br />year between the hours of 8:00 a.m. and lO:O0 p.m. daily. <br /> <br /> <br />
