<br />minimum standards necessary to make all dwelling structures safe, sanitary,
<br />free from fire and health hazards and fit for human habitation and beneficial
<br />to the public welfare, and

<br /> WHEREAS, this Ordinance constitutes an emergencymeasureproviding for
<br />the immediate preservatic~of the publichealth, safety andwelfare, and for
<br />the usual daily operation of a municipal department; now, therefore,

<br /> Section 1. 7hat Sectic~ 1305.04 of the Building Code of the Oodified
<br />Ordinances of the City of Lakewood n~w reading as follows:

<br />1305.04 APPLICATIC[g
<br />
<br />(a) This Code shall apply to all buildings and other structures or
<br /> portions thereof which are used, designed or intended to be used
<br /> for residential occupancy.
<br />(b) Existing buildings may cc~tinue robe occupied for residential
<br /> purposes if:
<br />
<br />(1) The building oomplies with the provisi~s of this Code except
<br /> as to any variance heretofore specifically granted by the
<br /> Board of Zoning Apioeals and Board of Building Standards of the
<br /> City.
<br />
<br /> (2) The use and occupancy of the building is not in violation of
<br /> any of the provisions of City ordinances and applicable
<br /> statutes of the State of Ohio, including any rules or
<br /> regulations adopted pursuant to such ordinances or statutes.
<br />
<br />(c) The provisions of this Code shall apply to all such buildings and
<br /> other structures or portions thereof which are in existence at, or
<br /> which may come into existence after the effective date of this
<br /> code.

<br />1305.04 APPLICATION

<br />(a) This Oode shall apply to all buildings and other structures or

<br /> for dwellings, dwelling mits, structures or occupiable structures.
<br />
<br />(b) Existing building may continue to be occupied for dwellings,
<br /> dwelling units or occupiable structures if:
<br />
<br />(1) The buildings or structure complies with the provision of this
<br /> Code except as toany variance heretofore specifically granted
<br /> by the Board of Zoning Code A~s ar~ Board of Building
<br /> Standards and Building Appeals of the City.
<br />
<br />(2) The use and occupancy of the building or structure is not in
<br /> violation of any of the provisions of City ordinances and
<br /> appli_~ble statutes of th~ State of Ohio, including any rules
