ORDINANCE NO: 30-84 <br /> <br />BY: Chinnock, Graham, <br /> McBride, Salmon, <br /> Wendl i ng <br /> <br /> AN EMERGENCY ORDINANCE consenting to the improvement of <br />Madison Avenue from West ll7th to Riverside Drive, in the City of <br />Lakewood, all in accordance with plans, specifications, and estimates <br />prepared by the City Engineer, and under the supervision of the Depart- <br />ment of Transportation, State of Ohio. <br /> <br /> WHEREAS, the Department of Transportation, State of Ohio, is <br />considering the repair and resurfacing of Madison Avenue from West ll7th <br />Street to Riverside Drive in the City of Lakewood, and <br /> <br /> WHEREAS, this Council has determined that the improvements <br />hemein provided are necessary to eliminate existing hazards to vehicular <br />traffic using the streets of the City of Lakewood, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure pro- <br />viding for the immediate preservation of t'he public health, safety and <br />welfare,sa~.d, eme~§~ncy existing by the present condition of said road <br />and for the further reason that it is necessary to expedite the prepar- <br />ation of the plans and specifications for the improvement; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That it is declared to be in the public interest <br />that the consent of the City of Lakewood be and such consent is hereby <br />given to the Department of Transportation, State of Ohio, to construct <br />the above-described improvements in accordance with the plans, specifi- <br />cations, and estimates approved by the Department of Transportation, <br />State of Ohio. <br /> <br /> Section 2. That the City of Lakewood hereby proposes to coop- <br />erate with the Department of Transportation, State of Ohio, in the above- <br />described improvement as follows: <br /> <br />(a) By the preparation of plans and specifications for <br /> the improvement to be approved by the Department <br /> of Transportation, State of Ohio; and <br /> <br />(b) By assuming and contributing the non-federal share <br /> of the project costs. <br /> <br /> Section 3. That the Mayor of the City of Lakewood is hereby <br />authorized to enter into maintenance and parking agreements and special <br />contractual obligations. <br /> <br /> Section 4. That upon completion of said improvements the City <br />of Lakewood will thereafter keep said street open to traffic at all times, <br />and: <br /> (a) Maintain the improvement in accordance with the pro- <br /> visions of the statutes relating thereto and make <br /> ample financial provisions for such maintenance; <br /> <br />(b) Maintain the right-of-way and keep it free of <br /> obstructions in a manner satisfactory to the <br /> Department of Transportation, State of Ohio, <br /> and hold said right-of-way inviolate for <br /> public highway purposes and permit no signs, <br /> posters, billboards, roadside stands or other <br /> private installations within the right-of-way <br /> limits. <br /> <br /> <br />
