Section 5. That traffic control signals will not be installed on the project without prior approval by the Department of Transportation, State of Ohio, and the City of Lakewood will place and maintain all traffic control signals conforming to the Ohio Manual of Uniform Traffic Control Devices on the improvement in compliance with the provisions of Section 4511.11 and r~hated sections of the Ohio Revised Code. Section 6. Right-of-way, utility rearrangement: (a) That all existing street and public right-of-way within the Municipality which is necessary for the aforesaid improvement, Shall be made avail- able therefor. (b) That any traffic signalization upgrading,=elocation of publically owned utilities or waterline work made necessary by the improvement will be included in the project but that the City of Lakewood will cause to be made, at no ex- pense to the Department of Transportation, State of Ohio, all changes, alterations or repairs to all private or public utilities which are not made necesSary by the improve- men t. (c) That the construction, reconstruction and/or rearrangements of both publically and privately owned utilities, referred to in subsection (b) above, shall be done in such a manner as not to interfere unduly with the operation of the contractor Constructing the improvement, and all backfilling of trenches made necessary by such utility rearrangement shall be performed in accordance with the provision of the Depart- ment of Transportation, State of Ohio Construc- tion and Material Specifications. Section 7. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such de- liberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compli- ance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 8~ That this Ordinance is hereby declared to be an emer- gency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adop- tion and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
