Section 5. That traffic control signals will not be installed <br />on the project without prior approval by the Department of Transportation, <br />State of Ohio, and the City of Lakewood will place and maintain all traffic <br />control signals conforming to the Ohio Manual of Uniform Traffic Control <br />Devices on the improvement in compliance with the provisions of Section <br />4511.11 and r~hated sections of the Ohio Revised Code. <br /> <br />Section 6. Right-of-way, utility rearrangement: <br /> <br />(a) That all existing street and public right-of-way <br /> within the Municipality which is necessary for <br /> the aforesaid improvement, Shall be made avail- <br /> able therefor. <br /> <br />(b) That any traffic signalization upgrading,=elocation <br /> of publically owned utilities or waterline <br /> work made necessary by the improvement will <br /> be included in the project but that the City <br /> of Lakewood will cause to be made, at no ex- <br /> pense to the Department of Transportation, <br /> State of Ohio, all changes, alterations or <br /> repairs to all private or public utilities <br /> which are not made necesSary by the improve- <br /> men t. <br /> <br />(c) That the construction, reconstruction and/or <br /> rearrangements of both publically and privately <br /> owned utilities, referred to in subsection (b) <br /> above, shall be done in such a manner as not <br /> to interfere unduly with the operation of the <br /> contractor Constructing the improvement, and <br /> all backfilling of trenches made necessary by <br /> such utility rearrangement shall be performed <br /> in accordance with the provision of the Depart- <br /> ment of Transportation, State of Ohio Construc- <br /> tion and Material Specifications. <br /> <br /> Section 7. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this Ordinance <br />were adopted in an open meeting of this Council, and that all such de- <br />liberations of this Council and of any of its committees that resulted <br />in such formal action, were in meetings open to the public, in compli- <br />ance with all legal requirements including Section 121.22 of the Ohio <br />Revised Code. <br /> <br /> Section 8~ That this Ordinance is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its adop- <br />tion and approval by the Mayor; otherwise, it shall take effect and be <br />in force after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />President <br /> <br /> ' <br />Clerk <br /> <br />Approved <br /> <br /> <br />
