ORDINANCE NO. 62-84 <br /> <br />BY: <br /> <br />Placed on First Reading June 4, 1984 <br />Placed on Second Reading June 18, 1984 <br /> <br />Brown' Chinnock, Gallagher, Graham, <br />McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend paragraph (a) of Section 339.02 of <br />the Traffic Code of the Codified Ordinances of the City of Lakewood to further <br />restrict the use of residential streets by overweight vehicles. <br /> WHEREAS, an increasing number of complaints are being received from <br />residents regarding the unnecessary use of residential streets by vehicles weigh- <br />ing in excess of six tons which would by reason thereof be prohibited from <br />using such streets, and <br /> WHEREAS, this Council recognizes that the limited use of such side <br />streets by overweight trucks should be permitted for necessary delivery in a rea- <br />so,able regulated manner, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br /> for the immediate preservation of the public safety and welfare; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:- <br /> Section 1. That paragraph (a) of Section 339.02 of the Traffic Code <br /> of the Codified Ordinances of the City of Lakewood, now reading as follows: <br /> 339.02 CERTAIN STREETS RESTRICTED; SIGNS; PERMITS; BONDS. <br /> (a) Except for necessary delivery of materials or <br /> supplies to premises ~butting any such streets, in which <br /> case the vehicle will proceed by a route which will follow <br /> to or from the nearest intersection of the following <br /> specially named streets, no vehicle or.vehicles with trail- <br /> er or trailers, each or either unit of which weighs in <br /> excess of six tons, including the weight of the unit, <br /> shall be propelled or driven upon or over any street in <br /> the City, excepting Highland Avenue from Clifton Boulevard <br /> to Berea Road; Detroit Avenue; Bridge Approach; Madison <br /> Avenue; Warren Road from Detroit Avenue to Franklin Boule- <br /> vard; and Berea Road from Highland Avenue to Fischer Road. <br /> The Mayor as Director of Public Safety is authorized to <br /> place signs stating that no such vehicle or unit in excess <br /> of six tons in weight as herein provided is allowed to be <br /> propelled or driven over the streets within the City, <br /> excepting the streets herein named. However, the provi- <br /> sions of this subsection shall not apply to vans of moving <br /> and storage companies engaged in the business or moving <br /> household furniture and appliances over the following <br /> streets: Bunts Road; Warren Road southerly from Franklin <br /> Boulevard to the City limits; Riverside Drive and Hilliard <br /> Road; Lakewood Heights Boulevard from Warren Road to Alger <br /> Road. <br /> <br /> shall be and the same is hereby amended to read as follows: <br /> <br /> 339.02 CERTAIN STREETS RESTRICTED; SIGNS; PERMIT; BONDS. <br /> <br /> (a)(1) No vehicle or vehicle with trailer or trail- <br /> ers, each or either unit of which weighs in excess of six <br /> tons, including the weight of the unit, shall be propelled <br /> or driven upon or over any street in the City except West <br /> ll7th Street from Clifton Boulevard to Berea Road; Detroit <br /> Avenue; Bridge Approach; Madison Avenue; Warren Road from <br /> Detroit Avenue to Franklin Boulevard; and Berea from West <br /> llTth Street to Fischer Road, except for the necessary <br /> delivery of-materials and/or supplies to premises abutting <br /> any such streets, in which case the vehicle will proceed <br /> by a routq which will follow to or from the nearest <br /> intersection of the aforementioned specially named streets <br /> and shall exit the street of delivery from the point of <br /> entry. <br /> <br /> <br />
