(b) The City may acquire real and personal property <br />and may expend its funds only for a proper municipal public <br />pur po se. <br /> (c) The City cannot enter into contracts in deroga- <br />tion of its governmental powers, duties or functions. <br /> (d) The City has the power and authority to regulate <br />and control land use within the City, and to determine, <br />pursuant to law, reasonable regulations thereof and restric- <br />tions thereon through its planning process, zoning, building <br />and other regulatory codes. <br /> (e) The Cit, y may, as required by law (including <br /> Article VIII, Ohio Constitution), sell or lease land and <br /> improvements thereon to the Developer for a fair market sale <br /> value or rental value. The City expects to use the services <br /> of qualified independent appraisers in determining fair <br /> market sale value or rental value. <br /> (f) The City cannot engage in a Joint venture with <br /> and cannot lend its aid or credit to the Developer under and <br /> except as provided by the law, particularly'Article VIII, <br /> Ohio Constitution. <br /> <br />Section u_.:.. Representations o_.~fthe City. <br /> <br /> (a) The City will review its zoning, building and <br />other regulations as they may affect the Developer's proposed <br />redevelopment of the Project Area and will consider changes <br />thereto that may be made under the law and that may be in the <br />best interests of the City and /ts citizens with respect to <br />the proposed redevelopment of the Project Area. <br /> (b) The City is willing to cooperate with the Devel- <br />oper in its efforts to secure parcels owned by third parties <br />through the provision of information and assistance that is <br />generally available to the public and in the usual course of <br />carrying out the services and functions of the City; however, <br />the City cannot acquire, by purc~mse or the exercise of its <br />powers of eminent domain, the property of others, except to <br />provide for public improvements or services which are for a <br />public purpose, and except as otherwise allowed by law, <br />including ~ection 13 of Article VIII, Ohio Constitution. <br /> (c) The City will consider the relocation of its fire <br /> station located in the Project lWea, so that such location <br /> can be properly utilized in the redevelopment of such area. <br /> (d) The City will use its best efforts to cooperate <br /> with the Developer in its efforts to: (i) as permitted by <br /> law, secure tax-exempt financing for the'Developer and other <br /> <br /> <br />
