mitred to the City not later than <br /> <br />, 19 · <br /> <br />Sectio_n 6- Termination of Preliminary .Agreement. <br /> (a) This Preliminary Agreement shall terminate (i) on <br /> · 19 , unless it is extended by a writing executed <br /> by the Mayor~ behalf of the City and the Developer, or (ii) <br /> in the event such agreement or the redevelopment project <br /> contemplated thereby is determined to be contrary to law. <br /> <br /> (b) The City may terminate this Agreement if; <br /> (1) The feasibility report required by Section <br /> 2(b) of this Preliminary Agreement i:s not timely delivered to <br /> the City as required by sUch Section, unless the City waives <br /> such timely delivery in a writing signed by the Mayor and <br /> approved by the Director of Law. <br /> (2) The plans required by Section ~ of this <br /> Agreement are not timely submitted to the City· unless the <br /> City waives such timely delivery in 'a writing signed by the <br /> Mayor and approved by the Director of Law. <br /> .(c) It is hereby agreed that: (i) the City· its <br /> officers· employees, agents or consultants shall not be <br /> liable in damages to the Developer for any termination of <br /> this contract. It is further agreed that this Preliminary <br /> Agreement is entered into by the CitY in the execution of its <br /> governmental powers and to provide for the necessary planning <br /> for the redevelopment of a portion of the City, and that the <br /> City will use good faith efforts to fulfill its obligations <br /> hereunder, but the City, its offiers, employees, agents and <br /> consultants shall not be liable in damages to the Developer <br /> for any breach of this contract or for any failure to perform <br /> negligent Performance by the City,, its officers, employees, <br /> agents or consultants. <br /> <br />Section 7- t~mendment - Effective Data. <br /> (a) This Preliminary Agreement may be amended by the <br /> execution of a written instrument signed by the Mayor on <br /> behalf of the City and the duly authorized representatives of <br /> the Developer. <br /> (b) This Preliminary Agreement is executed in dupli- <br /> cate (each copy to be an original) by the undersigned and <br /> shall be effective as of , 1984. <br /> <br />6 <br /> <br /> <br />
